A Golden Mile purchase runs through three layers at once: Spanish national law for the contract and the deed, Andalusian rules for the transfer taxes, and the Ayuntamiento de Marbella for the licences, the plusvalía and the general plan that governs the parcel. On this strip the municipal layer is the one that decides timetables.

The municipal layer matters more here than almost anywhere on the coast, and there is a specific reason. Marbella's 2010 general plan revision was struck down by the Tribunal Supremo in three judgments handed down in October 2015, and the town hall adopted a protocol that December to work through what the ruling meant for services, licences and properties already standing. On a strip of walled plots built in the sixties and seventies and repeatedly extended since, that history sits directly underneath the parcel you are buying. A lawyer who treats a Golden Mile purchase as a standard Spanish conveyance will not go looking for it.

Mortgage work has its own local shape. A lender's valuer visiting a fifty-year-old villa behind a wall on this strip will price the land and then look hard at what has been added to it, and any structure that is not properly declared will either come out of the valuation or stop the loan. That makes the order of operations unusual: the planning and registry questions have to be answered before the mortgage application, not alongside it. National, Andalucían, and what is Marbella's

The clean separation is worth learning once. Contract law, the deed, the Registro de la Propiedad and the mortgage regime are national: they are identical whether the house stands on this strip or in Galicia. The transfer taxes are Andalusian — a resale attracts the region's transfer tax, a new build attracts IVA plus the stamp duty AJD — and they are set by the regional parliament, which is why a rate quoted in a three-year-old article is worth nothing.

The municipal layer is where the Golden Mile becomes specific. The Ayuntamiento de Marbella licenses the works, issues the licencia de primera ocupación, levies the annual IBI and settles the plusvalía on a sale, and it does all of that under a general plan whose 2010 revision was annulled and whose replacement is still in process. Marbella also heads judicial district number six of Málaga province, together with Benahavís, Istán and Ojén, so a dispute over a boundary wall or an unlicensed annexe on this strip is heard in Marbella's own courts.

How this runs, step by step

  1. Step 1

    NIE first, then everything else

    The NIE is the foreigner's Spanish tax identification number, and nothing — no deed, no mortgage, no utility contract, no tax filing — can be done without it. It is obtained at a police station or through a Spanish consulate, and appointments are the bottleneck. Start it the week the search becomes serious rather than the week an offer is accepted.

  2. Step 2

    Instruct a lawyer of your own

    The lawyer must be independent of the seller, the agent and the developer, and should be instructed before any deposit changes hands. Their first job is the nota simple from the Registro de la Propiedad and a comparison against the Catastro and the building itself. On this strip that comparison is where the real work is, and it is worth paying for properly.

  3. Step 3

    Ask the town hall the planning question

    Specific to Marbella

    Because the annulled plan revision left a municipal protocol behind it, the answer to what is legal on a specific Golden Mile parcel comes from the Ayuntamiento's urbanism department and not from the seller's file. Ask for it in writing, name the parcel, and ask specifically about anything added since the original licence. Do this before the arras, never after.

  4. Step 4

    Open the mortgage file early

    Specific to Marbella

    Spanish lenders assess the borrower and the property separately, and a non-resident file takes longer because income has to be evidenced across borders. On this strip the valuation is the slow half: an old villa behind a wall needs an appointment, a survey and often a second look. Give the bank the planning answers rather than letting it discover them.

  5. Step 5

    Sign the arras with conditions

    Arras penitenciales is the deposit contract, and it sets what each side loses if the deal fails. Where planning answers, a mortgage offer or a regularisation are still outstanding, they belong in that contract as conditions with dates attached. A deposit paid against an unconditional contract on an old Golden Mile villa is the riskiest money in the whole transaction.

  6. Step 6

    Notary, taxes, Registro

    Specific to Marbella

    The escritura pública is signed before a notary, who is a public official rather than either party's representative. Andalucía's transfer tax applies to a resale and IVA with AJD to a new build; both are filed within a statutory window. Registration at the Registro de la Propiedad follows, and the municipal plusvalía is settled with the Ayuntamiento de Marbella.

Some costs are fixed by law and some are yours to negotiate. Fixed: the Andalusian transfer tax on a resale, IVA with AJD on a new build, the notary's tariff, the Registro's fee, and the municipal plusvalía on the seller's side. Negotiable: your lawyer's fee, the survey, the agency arrangement, and who carries the cost of regularising anything the search uncovers. On a strip where the buildings are old and the paperwork often is not complete, that last item is the one worth arguing about, and it is usually worth more than the rest together.

Which court would hear a dispute about my house here?

It depends on when it was built and what the applicable plan allows on that parcel, which is exactly the question the Ayuntamiento's protocol after the plan annulment was written to handle. Some additions can be regularised and registered as an older work; some cannot, and then the honest answer is that the building is worth what it is worth without them. Get the town hall's written position before you agree a price either way.

Will a Spanish bank lend against a plot on this strip?

Against land alone, rarely and cautiously; against a completed house, routinely, provided the paperwork and the building agree. The valuer will price the plot and then examine every addition, and anything undeclared drops out of the figure.
