Start with the counter you will actually stand at. San Pedro is a district of Marbella, not a municipality, and it keeps a Tenencia de Alcaldía of its own on the grid — which is convenient and slightly misleading. The padrón, a certificate, a routine query: local. The building licence, the licencia de primera ocupación, the plusvalía municipal on a sale and the annual IBI: all of them are decided by the Ayuntamiento de Marbella, under a general plan whose recent history is the reason this town needs a proper title search rather than a quick one. Buyers who assume a district office is a town hall lose a fortnight finding out otherwise.

That history is not gossip. The Consejo de Ministros dissolved the Marbella corporation in April 2006 and a Comisión Gestora ran the municipality in its place, and the plan in force through the years before that has since been read against a great deal of irregular building. San Pedro was not exempt. So the useful instruction to a lawyer here is narrow and specific: trace the licence, not just the title, on anything built or altered in those decades, and get the answer in writing before the arras rather than after. It is the cheapest line in the whole transaction.

Three layers, one counter, and the residence question underneath

The separation is worth learning once, and it is short. The contract, the escritura, the Registro de la Propiedad and the mortgage rulebook are national — a San Pedro purchase and a purchase in Oviedo run on the same statutes. The tax on the transfer is regional: Andalucía sets ITP on a resale and the AJD stamp duty that accompanies IVA on a new one, the regional parliament moves those rates when it chooses, and any figure printed on a page is out of date by definition.     NIE first, and the padrón question

    Specific to Marbella

    The NIE is the foreigner's Spanish tax number and nothing signs without it, so book it the week the search turns serious. San Pedro adds a second question most coastal purchases never raise: whether you will also take the padrón at the district office and become a registered resident here. The two are not the same paper, and the second one has consequences the first does not.

    Brief the lawyer on the decades

    Specific to Marbella

    Instruct a lawyer who acts for you and nobody else, and give them the period as well as the address. Anything in San Pedro built or altered between the nineteen-nineties and the years after the corporation was dissolved sits inside a municipal planning history worth reading properly. Ask for the licence file, not only the nota simple, and ask for it in writing.

    Settle the residence question early

    Before a mortgage application goes anywhere, decide whether you are buying as a tax resident of Spain or as a non-resident. Lenders run the two as separate products, with different documentation and different terms, and the same answer fixes how the property is declared each year. Changing your mind after the loan is drawn is possible and tedious; deciding first costs one conversation.

    Give the valuer the file

    A Spanish lender values the property independently of you, and in a town of forty-year-old blocks the valuation is the slow half of the file. Hand over the registry description, the community's works history and any licence answer your lawyer has already obtained, rather than letting the valuer discover a glazed terrace that appears nowhere. A prepared file moves; an unprepared one stalls quietly.

    Arras with dates attached

    The arras penitenciales contract sets the deposit, the completion date and what each side loses if the deal fails. Where a licence answer, a mortgage offer or a regularisation is still outstanding, it belongs in that contract as a condition with a date on it. A deposit paid unconditionally on a flat whose paperwork has not been read is the riskiest money in the transaction.

    Notary, taxes and the municipal tail

    You sign the escritura before a notary, who serves neither side, the transfer tax or IVA with AJD is filed inside its statutory window, and the purchase is entered at the Registro de la Propiedad. Afterwards the municipal tail is Marbella's: the IBI moves into your name, the seller settles the plusvalía with the Ayuntamiento de Marbella, and the routine paperwork can be lodged at the Tenencia in San Pedro.

Two things decide what a San Pedro purchase costs beyond the price, and only one of them is negotiable. The statutory half is not yours to argue: Andalucía's transfer tax on a resale, IVA with AJD on a new unit, the notary's tariff, the registry fee, and the plusvalía municipal the seller settles with the Ayuntamiento de Marbella. The other half is a set of choices — which lawyer, whether to survey, what the agency arrangement is, and who pays to regularise a terrace that was glazed in when nobody was checking. In a grid of forty-year-old blocks that last item is the one that moves, and it is settled in the arras or not at all.

It depends on tax residence, not on owning a home and not on nationality. San Pedro is the Marbella address people most often move to permanently, so the question comes up here far more than on the resort strips. How far back should a title search in San Pedro go?

Far enough to cover the licence, not just the ownership. The registry will tell you quickly who owns the flat and what charges sit on it; that is the easy half. The harder half is whether the building, the terrace enclosure or the ground-floor conversion was licensed at the time, and in this municipality that question reaches back into the planning years that ended with the corporation being dissolved in 2006.
