Letting in San Pedro, where the licence starts with your neighbours
In San Pedro the default let is a twelve-month tenancy to somebody who works on this coast, not a week to a visitor. That makes the community meeting, rather than the tourist register, the first hurdle: these are small resident-owned blocks, and the neighbours voting on your plan shop where you shop.

Decide first which business you are in, because Spain treats them as different things. A vivienda con fines turísticos is a tourist let, governed in Andalucía by Decreto 28/2016: you file a declaración responsable, the property is inscribed in the Registro de Turismo de Andalucía, and the registration code has to appear in every advertisement. A twelve-month tenancy under the urban leases act is not that at all, and needs none of it. In San Pedro the second is the ordinary case and the first is the exception, which is the opposite of how the beach urbanisations east of the Guadaiza are set up.
The second decision is whether the building will have you. Under the horizontal property rules a community can bar tourist letting by a qualified majority, and in San Pedro that vote is not an abstraction: the grid is full of small blocks owned by people who live in them, and the neighbours deciding your plan are the ones you pass at the market hall. Read the statutes and the last five sets of minutes before you buy, not after. Where the answer is no, a long tenancy is rarely a consolation prize here — the town keeps its theatre at La Alcoholera, its shops and its schools open through the winter, and a resident tenant is easier to find in January than a guest.
The season in San Pedro, and the licence position in Marbella
The season here is shallow and the year is deep. Demand for weeks concentrates in July and August and on the streets nearest the promenade; demand for months runs from September to June and is spread across the whole grid. That shape argues for a tenancy rather than a turnover operation in most of the town, and it is the single largest difference between letting in San Pedro and letting on a resort strip. It also means the winter is not a void to be survived but the part of the year that pays.
On the licence, be careful and be current. As at 27 August 2026 the Andalusian regime for tourist lets is Decreto 28/2016, which requires a declaración responsable, inscription in the Registro de Turismo de Andalucía and the registration code in every advertisement. Municipalities are a separate question and they move at their own pace: Málaga city, an hour up the coast, has a three-year suspension of new tourist-flat licences on residentially zoned land running from mid-2026. San Pedro sits in Marbella, a different municipality with its own position, and the only safe course is to ask the Ayuntamiento de Marbella about your exact address in writing before you commit. Step 1
Choose the regime, and write it down
Tourist letting and residential letting are separate legal products with separate obligations, separate tax treatment and separate insurance. Pick one deliberately at the start rather than drifting into whichever fills the calendar, because a flat furnished, contracted and insured for one is poorly set up for the other. Write the choice into the purchase file so that the lawyer, the accountant and the insurer are all working from it.

Take the neighbours' temperature early
Specific to Marbella
Before an offer, read the community statutes and the last several sets of minutes for any resolution on tourist use, and ask the administrator whether the subject has been raised. In San Pedro the owners are largely residents rather than absentee investors, so the vote tends to be decided by how the building already feels about strangers on the stairs. That is knowable in advance, and it is cheaper to know than to test.

Ask Marbella about your own address
Specific to Marbella
San Pedro is administered by the Ayuntamiento de Marbella, and municipal positions on tourist letting move independently of the region and of each other. Ask the municipality in writing, naming the street and the property, what applies on the date you are asking, and keep the reply. Do not reason from what a neighbouring municipality has done, in either direction, and do not treat an agent's summary as an answer.

Register with the Junta if tourist
If the answer is a tourist let, the Andalusian route is a declaración responsable followed by inscription in the Registro de Turismo de Andalucía, after which the registration code must appear in every advertisement you place. The declaration is a statement that the home already meets the requirements, not a request for permission, so the compliance work happens before you file rather than afterwards.

Fit out for a household
A resident tenant wants storage, a washing machine that works, heating that is honest about February, and somewhere to leave a bicycle. None of that photographs well and all of it decides how long they stay. In a five-storey block without a lift, be blunt in the listing about which floor it is; a tenant who discovers the stairs on viewing day has already stopped listening to the rest.

Contract, fianza and the annual return
A residential tenancy has a statutory shape: a written contract, a deposit that is lodged rather than kept, and rules on duration and renewal that favour the tenant. Have a Spanish lawyer draft or review the first one and reuse it afterwards. Then agree with your accountant, before the first rent arrives, how the income is declared and by which deadline, because a letting business found afterwards is expensive to tidy.
What a San Pedro flat earns is a question of months rather than of weeks, and the honest shape is steady rather than spectacular. A twelve-month tenancy inside the grid earns less per night than a July booking on the promenade and earns it every month, including the ones when the beach urbanisations are dark. The variables that move the figure are the same ones that move a sale: a lift, a parking space, a terrace, and how close the front door is to the market. The market hall, the pharmacies, the schools and the theatre at La Alcoholera all operate through the winter, which means a tenant can live an ordinary life here in January rather than driving somewhere else for it. That is the practical reason long tenancies work in San Pedro and struggle in a beachfront urbanisation, where a tenant in February has no shop, no neighbour and no bus.

What does a San Pedro tenant expect a flat to include?

The things a household needs rather than the things a holiday photograph shows. Storage, a working washing machine, heating that copes with a damp February, somewhere for a bicycle, and an honest statement of which floor it is and whether there is a lift. Furniture matters less than most owners think; a resident will often bring their own. What loses a tenancy here is a fifth floor described as a top floor, a terrace that turns out to face a light well, and a community charge that arrives as a surprise.
