La Cala de Mijas is where new housing in this municipality is genuinely built, on the coastal strip and through the golf valley behind the A-7. That makes the licence chain the thing to understand: a municipal works route, an occupancy declaration afterwards, and a bank guarantee over every payment you make in between.

The geography explains the supply. Mijas has three urban districts and the two on the coastal side are the ones with room, so an off-plan buyer in this municipality is nearly always looking at La Cala or Las Lagunas rather than the village. Within La Cala the new stock divides much as the resale stock does: apartment schemes near the coastal strip and the promenade, and lower-density houses spread through the valley around Calanova, Cerrado del Águila, La Noria, El Chaparral and La Cala Resort. Which of those two you are buying determines the completion risk you are taking as much as the developer does.
The paperwork is where an off-plan purchase is either safe or not. Mijas runs a Licencia de Obras route and a Declaración Responsable de Obras route for the construction itself, and a separate Declaración Responsable de Ocupación y/o Utilización for putting the finished building into use. That last step is the one that gates utility connections, mortgage drawdown and your ability to resell, so a completion date quoted without reference to it is a builder's estimate rather than a legal position. Ask which route the scheme is on and what stage it has reached before you reserve anything.
What is under construction on this side of Mijas
Mijas builds on the coastal side, and La Cala carries much of it. The framework is the town's own geography: a coastal strip with twelve kilometres of municipal shoreline behind it, and an inland valley organised around five golf clubs — La Cala Resort's three eighteen-hole courses and short course, Calanova at Finca El Cortijo Colorado, Cerrado del Águila on the Camino de Acevedo, La Noria at El Llano de la Cala and Chaparral at kilometre 203 of the old N-340. New residential phases attach themselves to that framework rather than appearing at random.
This page deliberately does not publish a list of schemes. Any list would be stale within a season, and a stale list is worse than none: it sends a buyer to a phase that sold out, or worse, lends the appearance of endorsement to something Paula has not inspected. What Paula does instead is name the schemes that are genuinely releasing at the moment you ask, say which she would put a client into and which she would not, and explain the licence stage each has reached. That last point is the one that separates a firm delivery date from an aspiration, and it is the only part of an off-plan pitch that can be verified independently at the Ayuntamiento.

A reservation taken at that stage is money at risk for no corresponding certainty.

See the guarantee, not the promise
Spanish law requires every amount you advance before delivery to be covered by an insurance policy or bank guarantee and held in an account separate from the developer's other funds. Ask for the policy or aval document and the account details in writing. A developer who cannot produce them is a developer to walk away from.

Read the specification, not the render
Get the memoria de calidades in writing and check what is fixed and what is described as equivalent. On this coast the differences that matter later are the glazing, the terrace waterproofing, the air-conditioning provision and whether the parking space is titled or allocated. Fix all four in the contract before signing anything.

Ask what the community will cost
Specific to Mijas
Ask for the projected community budget and, in the valley, for who will maintain the roads, lighting and gardens once the developer withdraws. A low first-year figure quoted while the developer still absorbs costs is not a forecast. In a golf-valley community the true steady-state figure is the one that matters at resale.

Follow the occupancy declaration

Completion is not delivery. In Mijas the finished building goes into use through a Declaración Responsable de Ocupación y/o Utilización, and until that is done the utilities, the mortgage drawdown and any onward sale are on hold. Make the notary date conditional on it rather than hoping it lands in the same week.

Step 6
Snag before you sign
Inspect the finished home with a technician before the deed, not after. Once you have signed, defects become a warranty claim rather than a condition of completion, and the difference in leverage is considerable. Book the inspection for a day the developer cannot conveniently postpone, and put the list in writing the same day.
An off-plan purchase is paid in stages and taxed differently from a resale: new construction attracts value added tax plus stamp duty rather than the transfer tax, and your lawyer will confirm which applies to the contract in front of you. Beyond that, budget for the notary, the registry, the mortgage arrangement if you use one, and the first year of community charges once the developer stops absorbing them. The cost that surprises buyers on this coast is furnishing a home that arrives empty on a date you did not choose.

Is a coastal-strip flat or a valley house the safer off-plan buy?

Different risks again. A coastal apartment scheme usually completes as a block, so your delivery depends on the whole building rather than on your unit; the upside is a deeper resale market if you change your mind. A valley house in a phased community may be delivered while roads and landscaping are unfinished, and the community budget will not settle until the developer withdraws. Ask for the phasing plan and the projected steady-state budget in both cases.

What happens if the developer misses the delivery date?

It depends entirely on what the contract says and on whether your money is guaranteed. Spanish law requires amounts advanced before delivery to be covered by a policy or bank guarantee and held separately, which protects the capital; it does not by itself give you a right to walk away on a late delivery. That right has to be written into the contract, with a defined long-stop date. Have your lawyer negotiate it before reservation, when you still have leverage.
