Nerja paperwork: the town hall here, the court in Torrox
Nerja keeps its own town hall but not its own court. The municipality sits in the ninth judicial district of Málaga province, seated in Torrox and shared with seven other Axarquía municipalities, so plusvalía and licences are settled here while a dispute over the same house is heard there.

Most of what a lawyer does on a Nerja purchase happens somewhere other than Nerja. The contract, the escritura and the entry in the Registro de la Propiedad are national law, and they read the same here as in Bilbao. The tax on the transfer — ITP on a resale, IVA with AJD on a new unit — is set for the whole of Andalucía and moves when the region decides it moves. What is genuinely local is a short list, and all of it sits at one counter: the plusvalía municipal, the IBI raised against the property, and the building and occupancy licences. The Ayuntamiento publishes a Sede Tributaria with a plusvalía simulator on it, which is more than a town this size usually offers.
The second layer is judicial, and buyers here rarely expect it. Nerja does not head a district of its own. It belongs to partido judicial number nine of Málaga province, seated in Torrox and shared with seven other Axarquía municipalities, Frigiliana among them. None of that touches an ordinary completion. It matters when a boundary, a retaining wall or an inheritance has to be argued, because the file then travels west rather than staying in town. The mortgage layer is national again, and it carries a clock: Ley 5/2019 gives the borrower ten calendar days with the documents before signing, and a free appearance before a notary no later than the day before the deed.
National, Andalucían, municipal — and the Torrox court
National law fixes the shape of the deal: the private contract, the escritura before a notary, the entry in the Registro de la Propiedad, and — where a bank is involved — Ley 5/2019, with its ten calendar days of documentation and its fee-free notarial appearance the day before the mortgage deed. A lender in a hurry cannot shorten either.
Andalucía owns the tax on the transfer. ITP applies to a resale, IVA with AJD to a new-build unit, and the rates are a regional decision that changes; no page should print them, and Paula's lawyer confirms the position in writing before you commit. Between the two sits the Registro's own filing, which is national in form and local in queue.
The municipal layer is short and it is entirely Nerja's: plusvalía municipal on a sale, the IBI raised against the property, refuse, and the building and occupancy licences. The judicial layer is not Nerja's at all. The municipality belongs to partido judicial number nine of Málaga province, seated in Torrox and shared with Algarrobo, Árchez, Canillas de Albaida, Cómpeta, Frigiliana, Sayalonga and Torrox itself. Ordinary completions never see it; contested boundaries and inheritances do.

Step 1
The NIE, then a power of attorney
The NIE is the foreigner's tax number, and no account, mortgage file, deed or utility contract exists without one. Apply through a Spanish consulate at home or in Spain, and grant your lawyer a power of attorney at the same time. Nerja sits at the far end of the province, so every unplanned signature is a long day rather than a short errand.

Step 2
Instruct a lawyer who is yours
The notary is impartial and the agent works for the transaction; neither is advising you. An independent lawyer reads the nota simple, compares the registered surface with the Catastro record, and asks what the terrace, the pool shell and the retaining wall were licensed as. On stepped Nerja plots those three things are where the deed and the building most often part company.

Work the plusvalía before the price

The Ayuntamiento de Nerja runs a Sede Tributaria with a plusvalía simulator, so the municipal figure can be tested before anyone agrees who carries it. Real Decreto-ley 26/2021 also allows the base to be taken as the real increase between acquisition and transfer values where that is the lower of the two. Have your lawyer run both and put the answer in the arras.

Step 4
Give the valuer the plot
Specific to Nerja
A mortgage valuation follows Orden ECO/805/2003, and the valuer works from what is registered and what is legally usable. Hillside stock here is held up by retaining walls and reached by stepped access, and both belong in the file rather than in a footnote. Send the surveyor's report, the community minutes on wall repairs and the access arrangement with the valuation instruction.

Step 5
Use the ten days, then the acta
Ley 5/2019 obliges the lender to hand over the FEIN, the FiAE, the draft contract and the allocation of costs at least ten calendar days before signature, and obliges the borrower to appear before a notary no later than the day before the mortgage deed. That appearance carries no fee and cannot be delegated, so book the flights around it rather than around the escritura.

Register, then move the local accounts
Specific to Nerja
Registration, not signature, makes ownership good against third parties, so agree who lodges the escritura and when. Afterwards the municipal file becomes yours: the IBI record, the refuse charge and the cadastral entry at the Ayuntamiento de Nerja, and the water account, which here is held with the town's own supplier rather than a coast-wide operator and transfers with the house.

Some of this is fixed by statute and some of it is argued, and the split is worth knowing before the arras. Fixed: the Andalucían transfer tax, the notary's tariff, the Registro's fee, and the plusvalía the Ayuntamiento de Nerja calculates — which its own simulator will show you in advance. Negotiable: your lawyer, the survey, the lender's arrangement charge, the valuation, and which party carries each of the fixed items. Will a lender value a stepped hillside house differently?

The rules are the same everywhere — Orden ECO/805/2003 governs the tasación — but what the valuer can confirm is not. On a stepped plot the usable ground, the retaining structures and the access are all part of the value, and if they are undocumented the valuation tends to come back cautious rather than wrong. The fix is preparation: send the surveyor's report on the walls and drainage, the community minutes covering any shared structure, and the registered access with the instruction.
