Letting in Nerja, against the town's own hotels
Letting in Nerja competes with the town's own hotels in July and with almost nothing in November, and every guest arrives by road because there is no rail east of Málaga. The licence question runs through the Junta's VFT regime and through the Ayuntamiento de Nerja, and both are worth confirming in writing.

The competitive picture here is unusual for the eastern coast. Nerja has a substantial regulated bed stock of its own, hotels and hostales in numbers a village cannot match, so in high summer a private flat is not the only option a visitor has. That has a useful consequence: the guest who chooses a home over a hotel here is choosing space, a kitchen and a terrace, and will pay attention to whether those are actually good. Photographs of a sofa will not carry a listing in a town where a hotel with a pool is two streets away. What carries it is a real dining table, storage, shade in August and heating in February.
The second constraint is arrival. There is no commuter rail east of Málaga, so every guest reaches Nerja by car, transfer or bus. The practical effect lands on parking, and it lands hardest in the streets around the Balcón in August. If the property has a deeded space, that is the single most valuable line in the listing. If it does not, say so plainly and tell the guest where they will actually leave the car, because the review that costs you a season is the one written by somebody who circled the old town for forty minutes with children in the back.
The season in Nerja, and the licence position in the municipality
Take the regulation first: it is the part that dates. Andalusian tourist letting runs on Decreto 28/2016: a licencia de ocupación, the technical housing standards, a declaración responsable to the tourism authority, entry in the Registro de Turismo de Andalucía and the registration code in every advertisement. The same decree excludes lets of more than two continuous months to one tenant. Since 3 April 2025, a building under horizontal division also needs three-fifths community approval under the Ley de Propiedad Horizontal. Both sources were read on 27 August 2026.
What no page can responsibly state is what the Ayuntamiento de Nerja will grant for a specific address. Municipal positions along this coast differ and are being revised, and Nerja is drafting a new PGOM, which is exactly the kind of instrument through which a town can change where tourist use sits. The only safe instruction is to obtain the town hall's position in writing, for your street, on the day you commit. The season itself is a short peak with a long, thin shoulder rather than a single summer. July and August are intense and compete directly with the town's own hotels. From October to May the demand is walking and sightseeing, drawn by the sierra, the river valley and a cave open almost every day of the year. It is a smaller market at a lower nightly figure, but it is real, and owners who equip only for the beach never see it.

Step 3
Clear the comunidad before you buy
Since 3 April 2025 the Ley de Propiedad Horizontal requires express approval by three fifths of owners representing three fifths of the quotas before tourist letting can begin in a building under horizontal division. Most Nerja apartment stock sits in exactly such a building. Read the statutes and the last two years of minutes before completion, not after, because a refusal afterwards is final.

Step 4
File and publish the registration code
Under the decree the operator files a declaración responsable identifying the dwelling, the owner and the form of exploitation before starting. Entry in the Registro de Turismo de Andalucía follows, and the resulting code must appear in every advertisement. Keep the filing, the code and the licencia de ocupación with the title deeds, because a future buyer will ask for all three in the same email.

Solve the car before the first booking

Because there is no rail east of Málaga, essentially every guest arrives with a vehicle. Either the property has a deeded space you can allocate, or the listing names the car park the guest should use and how far it is on foot with luggage. On a stepped scheme, say how many steps stand between that car and the door. Ambiguity here costs more than a lower nightly rate ever will.

Equip for walkers, not only swimmers
Specific to Nerja
The guest who fills the shoulder months in Nerja walks. The sierra behind the town, the river valley and the cave carry demand from autumn to spring, and those visitors want somewhere to dry boots, hang wet coats and sit indoors in the evening. Heating, a table, storage and a working connection decide whether the flat participates in six extra months of the year or only in August.

A Nerja home earns in a sharp peak and a long thin shoulder. The peak is priced against the town's own hotels, which sets a ceiling that a private flat cannot argue with on service alone; it can only win on space, a kitchen and a terrace. The shoulder is quieter, cheaper per night and far kinder to the building, and it is what separates an owner who works six months from one who works eight weeks. Can I let a Nerja flat by the month instead?

Yes, and it is a real option here rather than a fallback. Decreto 28/2016 excludes a letting of more than two continuous months to the same tenant from the tourist regime altogether, so a stay of three or four winter months is a different kind of contract with different paperwork and a different tax treatment. In Nerja the demand for that exists among walkers and long-stay winter residents. Decide which regime you want before advertising, because moving between them mid-season is untidy.

Will guests without a car manage in Nerja?

In the centre, yes; outside it, no. A flat within walking distance of the Balcón puts the market, the chemists, the restaurants and Burriana within reach on foot, and a bus or a booked transfer covers the airport. A house on the upper terraces or out towards Maro does not work without a vehicle, and pretending otherwise produces a stranded guest and a bad review. State which of the two you have in the first line of the listing.

Does a hillside townhouse let as well as a central flat?

Rarely, and the reason is logistics rather than charm. A stepped scheme without a lift means luggage, linen and cleaning all move by hand, which raises the cost of every changeover and narrows the guest profile to people who will happily climb. The compensation is space, a shared pool and quiet, which suits families staying a fortnight rather than couples staying three nights. Let it at fewer, longer bookings and price the changeover honestly into what you charge.
