Letting in Ojén, where La Mairena and the village differ

Ojén lets from two places at once. The village at 309 metres is a party-wall house on a narrow lane; La Mairena and El Vicario, in the south-east of the municipality, are detached houses with pools among cork oaks. Same town hall, same VFT regime, two entirely different letting businesses.

Begin with whether the house can be registered at all, because the answer differs by nucleus. Andalusian tourist letting runs on Decreto 28/2016, de 2 de febrero: the dwelling needs a licencia de ocupación and the technical standards applicable to housing, then a declaración responsable to the tourism authority, entry in the Registro de Turismo de Andalucía, and the resulting code in every advertisement — source read on 27 August 2026. A house on a lane in the old core may carry an occupancy history with gaps in it. A house at La Mairena or El Vicario usually does not, but it sits inside a comunidad de propietarios whose view carries weight the village house never has to ask for.

Then the year, which up here is not the beach year. The Junta's municipal sheet for Ojén publishes no hotel or hostal capacity at all: the accommodation block is suppressed under the note the service applies to a municipality with under five tourist establishments. A guest booking in Ojén is therefore not choosing between houses in Ojén. They are choosing altitude over the Marbella shoreline eight kilometres below, and they arrive up the A-355 with a car because there is no other way to arrive. That fact shapes the listing, the calendar and the changeover round far more than the pool does.

What the year looks like here, and who grants the licence

The regulatory part first, because it is the part that dates. Andalusian tourist letting is governed by Decreto 28/2016, de 2 de febrero: licencia de ocupación, the technical standards for housing, a declaración responsable, entry in the Registro de Turismo de Andalucía and the code in all advertising. Separately, since 3 April 2025 a property under horizontal division needs a three-fifths approval under the Ley de Propiedad Horizontal. Both sources were read on 27 August 2026.

What no page may tell you is what this municipality will allow. Ojén runs its own town hall, so the position that matters is Ojén's and not Marbella's, and municipal positions along this coast differ and are under active revision. Obtain the Ayuntamiento de Ojén's answer in writing for your address, keep the date on it, and re-confirm on the day you commit. The season is the more interesting half. With the municipality's own accommodation figures suppressed as under five establishments, there is no local hotel trade to compete with and none to lean on either. Demand is car-borne: Marbella visitors trading heat for altitude in high summer, walkers in spring and autumn, and a winter that suits a long tenancy better than a weekend.

    The village and the south-eastern developments are separate products with separate guests. A village house sells the square, the walk from the door and a short stay; a house at La Mairena or El Vicario sells a pool, a car and a week. Decide which one you are running before you write a single line of the listing, because the equipment, the cleaning round and the price logic all follow from it.

    Put the licence question to Ojén

    Ojén is its own municipality, so a position taken by Marbella eight kilometres downhill does not apply to your house. Ask the Ayuntamiento de Ojén in writing, for the specific address, what its position on tourist use is, and put a date on the reply. Municipal overlays on this coast differ and are being revised, so treat any answer as current on the day it was given.

    File the declaración responsable

    Under the decree, the operator files a declaración responsable identifying the dwelling, the owner and the form of exploitation before letting begins. Registration in the Registro de Turismo de Andalucía follows, and the code it produces belongs in every advertisement and every platform listing. Keep the filing, the code and the occupancy licence in one folder with the escritura, because a future buyer's lawyer will want all three.

    Read the comunidad where there is one

    Since 3 April 2025 a dwelling in a building or estate under horizontal division needs the express approval of three fifths of owners representing three fifths of the quotas before tourist letting can begin. In the south-eastern developments that vote is real and should be checked in the minute book before you buy. In the old core there is often no comunidad at all, only a shared wall and a neighbour.

    Write the drive into the listing

    Every guest here arrives by road on the A-355, and the last stretch is a mountain road with weather on it. Say so before they book: the hire car is not optional, the beach is a drive rather than a walk, and the descent takes longer after dark and in rain. Guests who know what they are choosing rate the house on what it is. Guests who expected a shoreline rate it on what it is not.

    Equip for the night, not the noon

    At 309 metres the August night is the product, and it is the one thing the coast below cannot sell. Say what the evening temperature does, give the terrace shade and light, and make the house workable when the sierra turns cold. Heating, a dry interior and a room worth sitting in extend the year at both ends far more reliably than another parasol does.

A house up here earns differently from one on the shoreline it looks down on. The summer peak is shorter and shallower, the shoulder months carry more weight than they do on the coast, and the winter is better let long than by the night. What performs is the house that is honest about the drive and comfortable after dark, not the one with the biggest terrace. Set against that, management is hands-on: every changeover, every delivery and every repair comes up the same mountain road, so running costs per booking sit above a coastal equivalent. Does Marbella's tourist-letting position apply to my Ojén house?

No. Marbella's decisions about tourist use stop at its own boundary, and your address is on the other side of it. The regional frame is shared: Decreto 28/2016, the licencia de ocupación, the declaración responsable and the Registro de Turismo de Andalucía code. Any restriction, condition or exemption on top of that belongs to the town hall in the village. Will a house here let in August with no beach?

It can, provided the listing sells the right thing. The guest who books Ojén in high summer is usually trading heat for altitude and quiet, having already seen what the shoreline costs and what it sounds like at two in the morning. The evening temperature, the shade on the terrace and the drive down to the water are the three facts that decide the booking. A listing that leads with a pool and buries the road tends to attract the guest who then complains about the road.

Is a pool worth its running cost at this altitude?

In the south-eastern developments, generally yes, because the whole product there is a detached house with outdoor space and a car. In the old core the question rarely arises, since the houses are party-walled with roof terraces rather than gardens. What matters more than the pool is the length of the usable season around it: an unheated pool at this height is comfortable for fewer weeks than one on the shoreline, so treat it as one reason to book rather than the reason.
