Benahavís paperwork: three layers, one village counter
A purchase in Benahavís is governed at three levels, and only the third is local. Contract, notary and mortgage law are national; ITP, IVA and AJD are set for Andalucía; but IBI, plusvalía municipal, works licences and the planning document that decides what you may build are all handled by one small town hall in the village.

The municipal layer deserves more attention here than it does almost anywhere else on the coast, because Benahavís has an unusually contested planning history. The general plan in force rests on a Texto Refundido approved by the provincial planning commission on 23 April 1997. A later partial approval, from 2018, was taken to the administrative chamber of the Tribunal Superior de Justicia de Andalucía, which declared the act radically null. The council then published its Revisión-Adaptación document under a plenary agreement of 29 October 2021, notified through an anuncio of 29 March 2022. The practical effect is that two documents circulate locally and your lawyer must name, in writing, which one the department applies to your parcel.
The mortgage layer is national and, since 2019, deliberately slow. A lender must deliver the full documentation at least ten calendar days before signature, and the borrower must attend a notary — one the borrower chooses — no later than the day before the deed is authorised, so that an acta recording the explanation can be drawn up. That acta carries no fee. For a foreign buyer in a village purchase this is genuinely useful: it forces a second, independent explanation of the loan in a setting where nobody is selling anything, and it happens before, not during, the signing.
National, Andalusian, and what belongs to this village
Keep the three layers separate and most of the confusion disappears. National law governs the contract, the deed, the notary's role, the property register and — since 2019 — the mortgage timetable, including the ten-day information period and the free notarial acta taken before signature. None of that changes between Marbella and Benahavís, and no local adviser can vary it.
The Andalusian layer is tax. ITP applies to resale purchases and IVA together with AJD to genuinely new ones; the rates are set at regional level and they move, which is why Paula's lawyer confirms them in writing at the time rather than a website quoting them. Andalucía also sets the tourist-home regime, which matters if you ever intend to let.
The municipal layer is the one people underestimate here. The Ayuntamiento de Benahavís bills the IBI, calculates the plusvalía municipal, issues works licences and first-occupation licences, and decides which planning document applies to your parcel — and in this municipality that last point is live, because a 2018 partial approval was annulled by the Andalusian high court and a Revisión-Adaptación was published by plenary agreement afterwards. On a village house with an old extension, that is not academic.

Step 1
Obtain the NIE early
The NIE — the foreigner's tax identification number — is needed to open an account, sign a deed and pay a tax, and it is the item most likely to hold up a timetable that everything else is ready for. Apply through the consulate in your own country or through a power of attorney granted to your Spanish lawyer, and start it the week you decide to buy rather than the week you find the house.

Appoint a lawyer, not the agent
Independent Spanish legal representation is the single highest-value line in a foreign purchase, and Paula's practice is to work alongside your lawyer rather than to substitute for one. The lawyer checks title, charges, licences and planning status, and holds the paperwork that later proves what you were told. Choose one before you sign a reservation, because a reservation already has terms in it.

Step 3
Ask which plan applies here
Specific to Benahavís
Because two planning documents circulate in this municipality, the buildable status of a village plot is not a matter of general knowledge. Have your lawyer request a written certificate from the Benahavís planning department naming the document applied, the classification of the land and any works licensed on the property. Do it during the arras period, when you still have the right to walk away.

Step 4
Run the mortgage on the statutory clock
If you are borrowing, the lender must give you the full information pack at least ten calendar days before signature, and you must see a notary of your own choosing at the latest on the day before the deed is authorised. Build those days into the arras deadline from the start. A completion date agreed without them is a date that cannot legally be met.

Sign, register, and move the utilities
The escritura pública is signed before the notary, taxes are settled, and the deed is presented for registration. Only then are you the registered owner rather than the buyer. On an old village house, allow extra time for the registry to reconcile the description, and expect the utility transfers to require documents the previous owner has not seen in years.

Settle the municipal side
Specific to Benahavís
IBI, the Catastro record, the plusvalía municipal on a later sale and any works licence you will ever need are all handled by the Ayuntamiento de Benahavís, in the village. That is a genuine convenience of buying in the nucleus rather than on the hillsides: the office is a walk away, and a question asked in person is answered by someone who knows the street.
Some of what you pay is fixed by law and some of it is not, and the distinction is worth knowing before anyone quotes you a package. Notary and land-registry charges follow a statutory scale; the acta the notary draws up before a mortgage signature carries no charge at all. Taxes are taxes. What is genuinely negotiable is the private side: the lawyer's engagement, the survey, the translation, and on a Benahavís village house the cost of curing an old planning irregularity — which is often the largest of them and the one nobody quotes for at the start.

Ownership of a lawfully built, registered house is not the exposure. What the dispute affects is what may be done next: an extension, a rebuild, a change of use, or the regularisation of something a previous owner added without a licence. Mortgage on a village house — what slows it down?

Often yes, but the valuation and the registered description do more work than they would on a new-build. A surveyor instructed by the lender values what is legally there, so an unregistered rear room or roof enclosure can reduce the figure the loan is calculated on even though you are buying the whole house. Resolve the description first. It also helps to remember the statutory clock: ten days of documentation and a notary appointment before signature are not negotiable, so agree the completion date around them.

For anything municipal, the town hall in the village: IBI, the plusvalía municipal on a sale, works licences, first-occupation licences and the padrón. For ITP, IVA and AJD, the Andalusian tax administration, through your lawyer. For your non-resident income tax position, the Agencia Tributaria. The mistake to avoid is assuming that a property marketed with an Estepona or Marbella address is administered there — the municipality on the nota simple decides, and for these streets it is always Benahavís.
