Off-plan in Benahavís, licensed in a village it cannot see
The Benahavís nucleus itself produces almost no new build — the streets are party-walled and finite. What the village does produce is licences: the municipality's largest off-plan schemes sit on hillsides several kilometres away, and every works permit and first-occupation certificate for them is issued from the town hall in the village.

The split is worth understanding before you sign anything, because it decides where your questions have to go. Inside the nucleus, a new house almost always means a replacement behind an existing facade rather than an addition. Outside it, on the same municipal territory, are the schemes that give Benahavís its off-plan reputation: Real de La Quinta, which is selling its Romero, Mimosas, Enebros, Sabinas, Palmitos, Quercus and Olivos phases around a lake club and an Angsana hotel with branded residences; and the Villa Padierna resort at Carretera de Cádiz kilometre 166, whose VP Collection markets villas and apartments beside its three courses. Both are Benahavís addresses. Neither is walkable from the village.
That geography sends the buyer up a road for the show house and down a road for the paperwork. The Ayuntamiento in the village grants the licencia de obra, and it is the same office that will later issue the licencia de primera ocupación — the first-occupation certificate that gates your utility contracts and, in practice, your ability to complete. It also decides which planning document applies to the parcel, and Benahavís has more than one in circulation. A buyer who has read the developer's brochure but never asked the village which document governs the plot has read the less important of the two.
What is under construction under this Ayuntamiento
Two named schemes account for most of what a buyer will actually be shown. Real de La Quinta, in Benahavís, is selling through a series of named phases — Romero, Mimosas, Enebros, Sabinas, Palmitos, Quercus, Olivos — alongside plots and private villas, arranged around the El Lago Club and an Angsana hotel with branded residences from the Banyan Tree group; the developer also records a BREEAM ES Urbanism certification, describing itself as the first project in Spain awarded that seal for town-planning infrastructure. The Villa Padierna Golf Resort, at Carretera de Cádiz kilometre 166 in Benahavís, markets its own VP Collection of villas and apartments beside the Flamingos, Alferini and Tramores courses.
The licence context is the half that brochures leave out. Every one of those homes needs a licencia de obra from this Ayuntamiento and, at the end, a licencia de primera ocupación from the same office before utilities can be contracted in your name. Sitting behind both is the planning framework: a Texto Refundido of the general plan approved on 23 April 1997 and a Revisión-Adaptación registered under number 8197 in November 2019. Check the guarantee, then pay
Spanish law requires a developer taking money before delivery to guarantee its return with legal interest through a seguro de caución or an aval solidario from a credit institution. Ask to see the policy or the guarantee itself, in your name, for your unit, and for each instalment — not a letter saying one exists. No guarantee, no payment.

Insist on the separate account
The same rule requires those advances to be received through a credit institution and held in a cuenta especial, kept apart from any other funds belonging to the developer and drawn only for the works. Your lawyer should confirm the account details on the contract match that description before the first transfer leaves your bank.

Snag before you sign
A handover inspection with an independent technician is the last moment your leverage is complete. Record defects in writing, agree dates, and hold the final instalment against them if the contract allows it. On a hillside plot in this municipality, pay particular attention to retaining walls, drainage and the finished level of terraces, because slope is where the money goes.

Wait for the first-occupation licence
Specific to Benahavís
The licencia de primera ocupación is issued by the Benahavís town hall and it is what turns builder's supply into your own utility contracts. It also confirms the finished building matches what was licensed. Completing before it exists is possible and is occasionally proposed; your lawyer should explain exactly what you are accepting if you agree to it.
An off-plan purchase under this Ayuntamiento is paid in stages, and the timing matters more than the total. A new home carries IVA plus AJD rather than the ITP that applies to a resale, and your lawyer confirms the current rates in writing before you commit. Instalments fall due against construction milestones rather than dates, each one guaranteed and each one paid into the developer's separate account. Budget for the guarantee, the lawyer and the snagging technician alongside the purchase itself — and assume nothing completes until the village has issued the first-occupation licence.

Is anything actually built new inside the village nucleus?

Rarely, and when it happens it is replacement rather than expansion. The nucleus is built to its party walls, the ground climbs steeply above it, and the gorge below sits inside a protected conservation area. What you occasionally see is a house rebuilt behind its own street facade, or a floor added where the plan permits it. If a brochure offers you a genuinely new home in Benahavís, check the address: it will almost certainly be on a hillside several kilometres away.

Off-plan on the hillside or an old house in the village?

They answer different questions. Off-plan on a hillside buys you a finished specification, a warranty period and a guaranteed deposit, at the cost of a delivery date you do not control and a life that runs entirely by car. A village house buys you a street you can walk, at the cost of a renovation you will manage yourself and a structure shared with a neighbour.
