Letting in Benahavís village, if the ocupación exists

Short letting in the Benahavís nucleus turns on one document most owners here have never seen: the licencia de ocupación. Andalucía's tourist-home regime requires it, and a village house built long before the paperwork existed may not have one — which is a harder obstacle than any community rule.

Andalucía regulates tourist homes through Decreto 28/2016, which covers dwellings on residential land offered for a price through tourist channels. Before letting begins the operator files a declaración responsable and the dwelling is entered in the Registro de Turismo de Andalucía, which returns a registration code that has to appear in every advertisement. The decree also sets out what the home must have — among them a licencia de ocupación, heating or cooling by season, a first-aid kit, complaint forms and a contact telephone. In a nucleus of party-walled houses, several generations old, the first of those is the one that stops applications. This is the position as at 26 August 2026; confirm it before you commit.

The second surprise runs the other way. On the coast, the fight over holiday letting is usually fought inside a comunidad de propietarios, and since April 2025 the Ley de Propiedad Horizontal has let three-fifths of owners approve, condition or prohibit the activity in their building. Inside this nucleus there is frequently no comunidad at all — houses stand on their own title with a shared wall and a handshake — so that vote does not exist. What replaces it is your neighbour, at close range, on a stepped street where suitcases are audible. Paula's read is that the neighbour matters more here than the regulation does.

The village season, and the licence position in Benahavís

The season does not look like the coast's. There is no beach, so July and August are not carried by sand; they are carried by evening trade in the restaurants and by the gorge below the village, where canyoning groups are briefed in the mornings. Autumn and spring hold up better here than on the shore, because walkers and golfers use the same valley and the dining rooms stay open for the residents of the surrounding urbanisations rather than for tourists. Winter is quiet without being closed. That produces a flatter, longer, lower-amplitude calendar — fewer peak weeks, more usable ordinary ones.

The licence position is national in outline and Andalusian in detail. Decreto 28/2016 governs tourist homes on residential land, requires a declaración responsable, an entry in the Registro de Turismo de Andalucía and a code shown in all advertising, and sets out equipment requirements including an occupation licence. It also excludes some arrangements outright: lettings of more than two continuous months to the same guest, and groupings of three or more dwellings held by the same owner in one building, which fall under a different regime. As at 26 August 2026 that is the framework, and it changes; treat it as the starting point for a conversation with your lawyer rather than as settled advice.

    Find the occupation licence first

    Specific to Benahavís

    Before anything else, establish whether the house has a licencia de ocupación or an equivalent municipal certificate. On buildings this old the document may exist in the Benahavís file, may need to be regularised, or may not be obtainable at all. That answer decides whether a tourist registration is a formality, a project or an impossibility — and it decides it before any money is spent on photographs.

    The decree lists what a registered tourist home must carry: cooling in the warm months and heating in the cold ones, a first-aid kit, tourist information, official complaint forms, clean linen, instructions for the appliances and a contact telephone. In a stone village house with thick walls and small openings, the cooling requirement is usually the one that needs an installer rather than a purchase.

    Solve arrival, parking and luggage

    This is the operational problem that decides reviews here. Guests arrive by car, the streets are stepped, and the last stretch is on foot with cases. Agree in advance where they leave the vehicle, meet them at that point for the first arrival, and say all of it plainly in the listing. A guest who discovers the climb on the doorstep writes a different review from one who was told about it.

    Talk to the neighbour before letting

    Where there is no comunidad de propietarios there is no vote, no minute book and no formal complaint route — which means an unhappy neighbour goes straight to the Ayuntamiento, in the village, minutes from your front door. A conversation before the first guest arrives is worth more than any clause. Agree quiet hours, bin days and where suitcases will not be wheeled at midnight.

    Match the calendar to the village

    Price and open the calendar around what actually brings people up the valley: dining, walking, the gorge in the warm months and the golf on the surrounding hillsides in the cooler ones. That is a different rhythm from a beachfront calendar, and copying a coastal pricing curve here leaves the shoulder months empty and the summer underpriced.

Earnings here are shaped by a calendar rather than by a peak. A village house does its best weeks when the restaurants are busy and the gorge is walkable, and it keeps a modest trickle through the shoulder months that a beachfront apartment does not. Against that, the nightly ceiling is lower than on the shore, because guests are not paying for sand, and the operating burden is higher: no lift, no concierge, luggage carried up steps. My village house has no occupation licence — what now?

Take it to the Benahavís town hall before you take it to a platform. Some old houses have an equivalent certificate on file that nobody has looked for; some can be regularised through the planning department; some cannot, because what stands does not match what was ever authorised. The answer changes the whole plan, and it is cheap to obtain. Letting without it is not a paperwork risk you can price — it is the ground the entire registration stands on.

There is no comunidad here — can neighbours still stop me?

Not by vote, but that is not the only route. The three-fifths majority that lets owners condition or prohibit tourist letting only exists where there is a comunidad de propietarios to hold the meeting, and many houses in the nucleus have none. What a neighbour can do instead is complain — about noise, refuse, parking or works — directly to a town hall that is a few minutes' walk away and knows every street by name. In practice that is a faster mechanism than an owners' meeting.

When is the village genuinely full of visitors?

At dinner, most of the year, and in the mornings of the warm months when groups gather for the gorge. That is a very different pattern from a beach town, where the day is the product and the evening follows it. Here the evening is the product, the visitors are often driving down from the surrounding urbanisations rather than staying overnight, and the guests who do stay are usually here for walking, eating or golf on the hillsides. Price the calendar to that rhythm rather than to a coastal one.
