Buying at El Higuerón, where the phase decides the view
El Higuerón is a master-planned hillside above Carvajal rather than a neighbourhood, so a purchase here is decided by the plan: which phase the block belongs to, how high it stands on the slope, and what the amenity membership attached to it actually includes. There is nothing old to buy.

Everything on this hillside belongs to a drawing, which changes what due diligence means. In a town you check a building; here you check a plan. The questions that decide a purchase are which phase your block sits in, how high on the slope it stands, whether the volumes below it clear your sightline permanently, and what has been consented for the ground above you. None of that is a matter of opinion — the whole hillside was consented as a scheme, so the answers exist on paper. A buyer who asks to see the remaining phases before making an offer is not being difficult; they are reading the only document that determines whether the view they were shown survives the decade.
The second thing that differs here is that the community charge is buying a product rather than a service. Higuerón West is presented by its developer, Urbania, as more than 750 apartments and villas with a beach club, sports club and spa membership and a coworking space attached, and a hillside carrying landscaped terracing, private roads and pools costs what that implies. So the useful question is not whether the charge is high. It is what your specific scheme includes, what is offered on separate terms, and whether the arrangement follows the flat when you sell it. Get that in writing before the arras, not from a brochure.
What is actually on the market on this hillside
The supply divides in two, and only in two. There is developer stock, sold from a plan or newly completed inside a scheme, and there is early resale, sold by owners who bought a phase or two ago. That is the whole market. There is essentially no renovation stock, because the buildings are not old enough to need it, and no vernacular housing at all: no village houses, no seventies blocks with original plumbing, nothing with a street behind it. A buyer arriving from a Spanish town expects a third category and does not find one.
The consequence is that comparison here is unusually literal. Two schemes a hundred metres apart can be near-identical in plan, orientation and finish, so what actually separates them is height on the slope, the phase they belong to, and what the charge includes. That makes the market efficient and slightly unromantic. It also means an asking price is easy to test: there is almost always a genuine comparable, sometimes two floors up in the same building.
The buyer beside you is international and increasingly year-round. Dutch, Belgian, Nordic and British purchasers take much of the stock, alongside Spanish professionals from Málaga who want a contemporary flat with a gym and a motorway slip, and investors buying to let. What unites them is that none of them are buying a Spanish street. Paula's read is that the people who are happy here decided that consciously; the ones who are not usually discovered it after completion.

Place the block inside the plan

Ask for the masterplan and identify your block on it: which phase, what height on the slope, what stands below and what ground remains above. The whole hillside was consented at once, so what will be built around you is a matter of record. Walk the terrace, look level rather than down, and match what you see against the drawing.

Read the membership, not the brochure
Specific to Benalmádena
Establish exactly what your scheme's charge covers and what sits on separate terms: the pools and gardens, the private road lighting, and access to the sports club and spa. Then establish whether that access transfers to a purchaser when you sell. On a hillside where the amenity is the product, this is the single most consequential document after the deed.

Confirm the municipality from the deed

Postal addresses inside Reserva del Higuerón are written as Avenida del Higuerón, 29640 Fuengirola, while the hillside itself falls within Benalmádena. Have your lawyer confirm from the escritura and the Catastro reference which municipality levies the IBI, issues works licences and answers planning questions for your specific unit. This is not cosmetic, and it is easiest to settle before the arras.

Step 4
Drive the access in both directions

The hillside is reached from exit 1008 of the coastal motorway and served by a private road system rather than a town grid. Drive it in the dark and in rain, not only at midday, and time the climb back up from the Cercanías halt at Carvajal. The descent is easy and the return is not, and that asymmetry shapes how the home is actually used.

Step 5
Have the title and charges checked
Your lawyer takes the nota simple, confirms ownership and charges, and matches the registered description against the Catastro and against what you walked through. In young stock the usual traps are terraces or storage annexed after handover and parking spaces described but not deeded. Both are cheap to regularise before completion and expensive to argue about afterwards.

Step 6
Reserve, contract, complete
A reservation takes the property off the market and the contrato de arras that follows fixes price, date and the consequences of withdrawal. Make the community position a written condition: budget, reserve fund, any approved levy and the amenity terms as described. After the escritura, put the IBI, the community charge and the utilities into your own name and set them to pay automatically.
ITP applies to a resale and IVA plus AJD to a purchase from the promoter, and Paula's lawyer confirms the rates in writing rather than a page quoting them. Notary, registry, lawyer and NIE sit on top. What is specific here is the running cost: a hillside community maintains landscaped terracing, private roads, lifts and pools, and where a scheme carries sports club and spa access that arrangement has its own terms. Those charges sit materially above a plain apartment block in the same municipality, and they are structural rather than negotiable. Read the budget and the reserve fund before you decide what the flat costs to hold.

Should I buy from the developer or from an owner?

They are different transactions rather than different prices. Buying from the promoter means staged payments against a guarantee, a specification you can influence and a completion date that may move. Buying an early resale means one payment at the notary, a building you can stand inside and a community whose first budgets already exist. On a hillside where phases are still being released, the resale advantage is certainty and the developer advantage is choice. Decide which of the two you actually need before you look.

Is there any older housing on this hillside at all?

Effectively none, and that is worth saying plainly. The hillside was drawn and built as one contemporary scheme, so there is no village core, no older block and almost nothing to renovate. A buyer who wants character, a project or a price attached to a tired building will not find it here at any budget, and should look down the hill towards the towns rather than up it. What you get in exchange is predictability: young buildings, warranties still running and a known specification.

How do two near-identical schemes here differ in practice?

In three things, and only three. Height on the slope, because the block below decides whether your sea view is whole or partial. Phase, because specification, lift arrangements and parking allocation change between releases. And what the charge buys, because access to the sports club and spa is not identical from one scheme to the next. Everything else — the plan, the finish, the terrace depth — really can be the same. Compare those three side by side and the choice usually makes itself.
