A guest on this hillside is not booking a beach. They are booking a sports club, a spa and a terrace above Carvajal, all of which sit inside a resort that also rents rooms of its own. So the first letting question at El Higuerón is what amenity access your specific flat can actually pass to a guest.

Most letting pages start with the licence. Here the first question is commercial, and it is unusual: what exactly can your guest use? The reason a family pays a premium for this slope rather than a flat down at Carvajal is a club, a spa and a hotel that keep running through the winter, and access to them is not automatic just because you own a flat nearby. Membership can attach to the dwelling, to you personally, or to a renewable annual contract, and a guest's entitlement is a separate question again. Establish it in writing before a listing goes live, because a booking sold on facilities that turn a guest away at the door is the one review that will follow the flat for years.
The second thing to plan is the arrival, which on a hillside is a real operating constraint rather than a detail. Access is from exit 1008 of the coastal motorway and then a private road system rather than a town grid, and the nearest rail halt is Carvajal on the Cercanías C-1, down at sea level. Walking down is easy. Walking back up with a suitcase is not, so a guest arriving by train finishes the journey by taxi and a guest arriving by air will almost always want a car and a space to put it in. Work out where a vehicle stops, how the lift behaves with luggage and where linen is stored before the first changeover, not during it.
What fills the calendar up here, and what the rules require
The season on this slope is wider than a beach calendar and it is carried by different things. High summer is strongest, as everywhere. What is unusual is the shoulder: a sports club, a spa and a hotel that keep operating when the coast thins out give a guest a reason to come in March or November that a pool and a view cannot. That advantage is real but narrow: Sollo, the starred restaurant inside the scheme, opens five evenings a week for one sitting. Describe what is genuinely open.
The competition is also unusual, because part of it lives inside your own development. A resort hotel on the same hillside sells the same view with a reception desk, daily housekeeping and a rate that moves in the quiet months. A flat does not beat that on price. It beats it on the things a room cannot supply: separate bedrooms, a kitchen, a terrace, a parking space and a stay long enough to unpack.
On the regulatory side, three layers apply and they are frequently confused. Regionally, Decreto 28/2016 governs a vivienda con fines turísticos: declaración responsable, entry in the Registro de Turismo de Andalucía, the code in every advertisement, and technical requirements for the dwelling. Nationally, since 3 April 2025 the community's express prior approval is required and a three-fifths vote may limit the activity. Municipally, the Ayuntamiento de Benalmádena had published no dedicated notice as at 27 August 2026, so obtain the position for your address in writing on the day you act.

The dwelling also needs a licencia de ocupación, which is a document to be produced rather than an assumption to be made.

Step 4
Meet the decree before the first booking
The Andalusian decree sets requirements a flat has to meet before it is let: direct exterior ventilation to bedrooms, a window-darkening system, cooling in the summer months and heating in the winter ones, among others — position as at 27 August 2026. On a west-facing hillside terrace the darkening and the cooling are not decorative choices, so put them in the refurbishment budget rather than discovering them after a complaint.

Plan the changeover on private roads

Changeovers here run on a private road system reached from exit 1008, not on a street with kerbside parking. Establish where a cleaning vehicle can stand, whether the service lift is the same lift the guests use, how far the walk from the visitor bay to the door is, and who holds a spare fob. A hillside scheme forgives a late arrival far less than a town block does.

Municipal positions on tourist letting differ along this coast and are being revised, and the Ayuntamiento de Benalmádena published no dedicated notice on the subject on its own site as at 27 August 2026. That is not permission and it is not a prohibition. Ask for the position on your exact address, in writing, on the day you act, and where letting is the plan, make it a written condition of any purchase.

A flat here earns unevenly, but less unevenly than a beach address. High summer carries the year, and the club and the spa keep spring and autumn from emptying entirely, while deep winter stays thin. Against that sit costs which never pause: a community charge maintaining terracing, private roads, pools and lifts through the empty months, whatever the amenity access costs to hold, and management, cleaning and changeover charges that scale with the number of stays rather than the income. Only if the arrangement attached to your flat says so, and that varies across this hillside. Access can run with the dwelling, with the owner personally, or under a renewable annual contract, and a guest's entitlement is a further question on top of that. Establish it in writing with the operator before the listing goes live, state the exact position in the advertisement, and price a day pass into the stay if that is what applies. Selling facilities a guest is then refused at the door is the fastest way to lose a season of reviews.

Is the Carvajal train halt any use to my guests?

For days out, yes. For arrivals, mostly not. Carvajal sits on the Cercanías C-1 at sea level below the slope, which puts the airport, Málaga and Fuengirola within reach without a car once a guest is settled. The problem is the climb back. The descent is easy and the return is not, so a guest arriving with luggage finishes the journey by taxi. Write the honest version into the listing: good for a day in Málaga, not a substitute for a hire car and a parking space.

Differently from a village block, but not predictably. Since 3 April 2025 tourist letting needs the community's express prior approval and can be limited or conditioned by a three-fifths vote of owners and quotas, and on this hillside those meetings are attended largely by people who do not live here. That tends to soften opposition. It does not remove it: owner-occupiers who do live here year round often care intensely about lift traffic, pool crowding and access to the club.
