New build at Estepona port means a rebuilt flat, not a phase

There is no off-plan on Estepona's quays, because the basin and its edges are public port domain administered by the Agencia Pública de Puertos de Andalucía, which is a use regime and not a residential one. What is marketed as new around the harbour is a rebuilt flat inside a block from the 1970s or 1980s.

The first thing to establish about anything sold as new here is which of three things it actually is. A flat stripped back and rebuilt inside an existing block is the commonest, and it arrives with a comunidad, a maintenance history and a set of neighbours already in place. A small infill building on the land towards Playa del Cristo is the second, and behaves like an ordinary new promotion. The third is a commercial unit on the quay, which is not a home and is not a freehold: it sits within the port's public domain and is held through the concession structure. Those three carry different guarantees, different taxes and different risks, and the brochure rarely distinguishes them.

The visible construction in this quarter is municipal rather than private. Estepona has been building a coastal corridor since 2011, and as at 30 May 2025 the Ayuntamiento reported it 95 per cent complete: 21 of a planned 23 kilometres connected, carried over the river mouths on 17 large timber bridges, with five sections left. One of those, Playa Baños–Matas Verdes, is 575 metres of boardwalk on which work had just started; another, Costa Natura, was still at draft stage. For a buyer near the harbour that programme matters more than it sounds, because a finished stretch turns a road-side address into a walkable one, and the walk is what a harbour flat is actually sold on.

What is actually being built around the harbour

The honest inventory is short and it is mostly public. Estepona's coastal corridor, begun in 2011, stood at 95 per cent as at 30 May 2025, with 21 of 23 kilometres connected and 17 large timber bridges carrying it over the river mouths. Five sections remained: Playa Baños–Matas Verdes, 575 metres of boardwalk then just starting; Bahía Dorada, with its authorisations obtained; Isdabe–Atalaya, awaiting permits; Guadalmina Baja–Casasola, approved; and Costa Natura, still in draft. That programme is the construction a harbour buyer will actually notice, because it decides how far you can walk from the harbour mouth without meeting a road.

Private activity is a different shape entirely. The quays cannot carry housing, so promoters work behind them: whole apartments taken back to the structure and rebuilt, occasionally a small building on the land towards Playa del Cristo. The legal frame is the ordinary one — the licencia de obra that authorised the work, the cover on advance payments restated by Ley 20/2015, the licencia de primera ocupación at the end, and the one-, three- and ten-year warranty periods of the Ley de Ordenación de la Edificación. What is not ordinary is the setting: a rebuilt flat here inherits a fifty-year-old comunidad, and no amount of new finish inside the door changes what the façade will cost the owners.

    Establish which of the three it is

    Before anything else, ask the promoter in writing whether you are buying a rebuilt unit inside an existing building, a unit in a genuinely new one, or a commercial concession on the quay. Each has a different legal shape and a different set of protections. A seller who cannot answer that question in one sentence has told you something useful about the rest of the file.

  2. Step 2

    Check what touches the port domain

    Specific to Estepona

    Anything that reaches the quay, the water or the port's own land is not the Ayuntamiento's to permit alone: the basin is administered by the Agencia Pública de Puertos de Andalucía and operated by its concessionaires. If a scheme promises a terrace, a mooring, an access or a garden that touches port land, ask which authority signed it off and see the paper. Promises about the quay are the ones most often made by people who cannot keep them.

  3. Step 3

    Secure the money before you pay

    Money handed over during construction has to be protected. Ley 20/2015 allows a developer to cover advance payments with an insurance policy or, alternatively, with a financial guarantee, and your lawyer confirms that the cover actually exists and names you before a single instalment leaves your account. A reservation receipt is not a guarantee, and a promoter's assurance is not a policy.

    Read the comunidad you are joining

    Specific to Estepona

    A rebuilt flat in an old block comes with the block's history. Ask for three years of minutes and accounts before you reserve, and specifically for any works already voted on render, railings or lift machinery. A new kitchen behind a fifty-year-old façade still pays its share of the façade. This is the single item that most often surprises a buyer who thought the word new covered the whole building.

  5. Step 5

    Wait for the occupation licence

    Specific to Estepona

    Whatever the product, completion waits for the licencia de primera ocupación issued by the Ayuntamiento de Estepona, which confirms that what was built matches what was permitted and unlocks the utility contracts. Paying the balance before it exists moves a real risk from the promoter to you, and no discount on offer at that stage is worth the exposure. Let the lawyer hold the line on the date.

  6. Step 6

    Snag while the warranties run

    The Ley de Ordenación de la Edificación sets cover of one year for finishes, three years for defects affecting habitability and ten years for structural defects, running from reception of the works. On a front-line building the first winter is the real inspection: driven rain finds every seal a summer handover hid. Write down what appears, date it, and send it while the shortest of those clocks is still running.

The tax treatment follows the legal shape rather than the marketing. A home sold new by its promoter carries IVA plus AJD; an ordinary resale carries Andalucía's transfer tax instead; and where a flat has been rebuilt, which of the two applies depends on the works and the unit's history, so Paula's lawyer settles it in writing before the reservation rather than after. Then there is the timing, which buyers underestimate: instalments leave across a build, sit guaranteed but idle, and the balance falls due when the occupation licence arrives. Add the building's own works programme, which you inherit on the day you complete.

Can anything new be built on the quay itself?

Not as housing. The quays belong to the port's public domain, administered by the Agencia Pública de Puertos de Andalucía and worked by its concessionaires, and that regime is about port and leisure uses rather than dwellings. Buildings do change there — a marine business fitting out, a restaurant rebuilding its premises — but what is being altered is a use held under concession, with a term attached. If a scheme claims to be selling you a home on the water side of the road, read the title before anything else.

Is a fully rebuilt flat sold as new build?

Sometimes, and it is a legal question rather than a descriptive one. Whether a rebuilt unit is treated as a first delivery or as a further transmission depends on the scope of the works and on what the property has been before, and the answer changes which taxes apply to your purchase. Have your lawyer state the position in writing before you reserve, and do not accept the brochure's word for it. The physical result may be new; the fiscal treatment of it is decided elsewhere.
