The planning context matters more here than the brochure. That single fact decides whether a demolition is an opportunity or a mistake: some of the earliest houses occupy a footprint that could not be authorised at the same size today, so the buyer of a rebuild is sometimes purchasing less house than the one that came down. A small promotion has no phase behind it to absorb a delay, so the payment schedule should follow stages you can stand on the plot and verify: structure complete, roof closed, services connected. Dates alone are the weakest possible trigger on a single-house build, because one archaeological pause or one supplier moves them all at once.

Licence of first occupation and snagging

The licencia de primera ocupación is issued by the Ayuntamiento de Marbella and gates utilities, registration and any letting. Do not complete before it exists, and hold a retention against the snagging list. On a replacement villa the list is short but specific: drainage falls, terrace levels and the connection of the new house to services that were laid decades ago.

Step 6
Register, connect and budget year one
After the notary, the new declaration of works is registered and the Catastro record is brought into line with what now stands. Then budget the first twelve months honestly: on a large plot that means planting, irrigation and pool plant, none of which the promoter delivers finished, and all of which the estate's mature neighbours will make obvious by comparison.
An off-plan purchase on this estate is priced from the plot upward, and the plot is the expensive part: Guadalmina sits above Nueva Andalucía and well above San Pedro de Alcántara on the Marbella ladder and below Puerto Banús. Beyond the contract sum, plan for the tax treatment that applies to a new building rather than a resale, the notary and registry, your lawyer, and the demolition and archaeological supervision where they apply. The garden and pool that make the finished house look like its neighbours are a separate budget, and a large one.

What appears as new build is therefore a house replacing a house, not a scheme filling a field.
