Selling in Guadalmina, where the licence file sets the price

Most Guadalmina houses went up between the club's inauguration in 1959 and the end of the 1990s, so a sale here is decided on documents rather than on styling. The licence file for six decades of extensions, and which side of the A-7 your comparables come from, move the price more than any photograph.

The seller's advantage on this estate is documentary. Marbella requires a building to present its first technical inspection report in the year after its fiftieth anniversary and to renew it every ten years, and Guadalmina's original villas have crossed that line. A seller who files the report before listing converts the buyer's oldest objection into a piece of paper. A seller who does not will meet the same question at the arras table, with less room to answer it. The same is true of the guest wing, the enclosed porch and the second garage that six decades tend to add: each has a licence somewhere, or it does not, and that is the negotiation.

The second thing to settle before a price is agreed is which Guadalmina the house is in. The A-7 runs through the estate, and the golf club addresses itself to Urbanización Guadalmina Alta at kilometre 1055 of that road; the beach at CN-340 P.K. 186,7 is on the far side. Alta and Baja produce different buyers, different walks and different comparables, and a valuation built from the wrong half is the most common reason a Guadalmina house sits unsold through a season. Who buys a house in Guadalmina

The buyer pool is narrow, informed and slow. Golfers dominate it, together with families who have already decided that plot size beats address glamour, and it draws heavily on people who know the estate because they have played it: the club opened in 1959 and now counts more than two thousand members. That produces buyers who arrive with a formed view about which streets they want, and who are almost never in a hurry.

What they cross-shop is predictable. Guadalmina sits above Nueva Andalucía and well above San Pedro de Alcántara next door on the Marbella ladder, and below Puerto Banús, so the realistic alternatives are a smaller plot closer to the marina or the same budget spent inland. Homes that sell slowly here are almost always one of two kinds: an unrenovated villa priced as if the work were already done, and a house whose licence trail cannot be produced on request. Neither is a market problem. Both are preparation problems, and both are solved before a listing goes live rather than after it has stalled.

    Establish which half you sell

    Before any figure is discussed, fix whether the house sits on the inland side, where the club addresses itself to Urbanización Guadalmina Alta at kilometre 1055, or on the seaward side that runs down to the beach. Comparables are then drawn only from that half. Mixing the two produces an asking price the market will spend a season correcting.

    Rebuild the licence file

    Your lawyer traces a licence for every addition the house has acquired and reconciles the built surface on the escritura with the Catastro record and with what actually stands on the plot. Marbella's 2010 general plan was annulled in 2015 and the 1986 plan governs again, so an old permission is read against an old instrument rather than a current one.

    Certificate, survey pack, launch

    The energy rating has to appear in every sale advertisement, so it is commissioned early rather than chased later. Alongside it, assemble the pack a serious buyer will ask for: plans, the licence trail, the community position where one exists, and recent works invoices. A house that answers questions before they are asked shortens its own marketing.

    Viewings, offer and arras

    Buyers here tend to arrive with an architect rather than a wish list, so viewings are technical and the questions are about water, movement and services. When an offer comes, the arras penitenciales contract fixes the deposit, the completion date and the consequence of withdrawal. Build the inspection and licence conclusions into that contract instead of leaving them to goodwill.

    Notary, retention and plusvalía

    At completion a non-resident seller has three per cent of the price retained by the buyer and paid in against non-resident income tax. The plusvalía municipal on the land is then settled with the Ayuntamiento de Marbella, which runs its own municipal tax office, and may be calculated on the objective basis or on the real gain where that is lower.

Guadalmina sits in the upper half of the Marbella ladder, above Nueva Andalucía and well above San Pedro de Alcántara, and below Puerto Banús. What comes off a seller's figure is mechanical rather than mysterious: the non-resident retention paid in at completion, the plusvalía municipal on the land settled with the Ayuntamiento de Marbella, your lawyer, and the agency. What is genuinely negotiable is the discount a buyer applies for an inspection you did not commission and a licence file you cannot produce. That discount is usually larger than the cost of removing it.

Should I commission the technical inspection before I list?

On this estate, usually yes. A large share of the original stock has passed the fiftieth year that triggers the first report, so the question will be asked anyway. Having it done, with the findings addressed, turns an open-ended worry into a closed item and takes away the blind discount a cautious buyer applies. Where the report reveals real work, you still gain: you choose the contractor and the price, instead of accepting the buyer's estimate of both during the arras negotiation.

Can I price my Guadalmina Alta house against beachside sales?

It is the mistake this estate punishes most reliably. The A-7 divides one name into two markets: the club side, which addresses itself to Urbanización Guadalmina Alta at kilometre 1055, and the seaward side that runs down to the beach registered at CN-340 P.K. 186,7. They attract different buyers and hold value for different reasons. A listing built on the other half's evidence will draw viewings that end politely and quickly, and the correction usually costs a season.

Does club membership transfer with the house when I sell?

Ownership of a house and membership of the club are separate things, and they have been throughout the estate's history. Since 2021 the club has belonged to its members, which makes the joining terms a matter for the club rather than for your contract. Sellers who imply otherwise in marketing create a disappointment that surfaces after the arras, when it is expensive. State the position plainly in the file and let the buyer approach the club directly on their own terms.
