Buying in Los Monteros, between Río Real and the servitude

In Los Monteros the geometry decides the purchase. The coastal law runs its servitudes across the seaward plots, Río Real closes the inland edge, and nothing new is being platted between them. What is for sale is somebody's plot from the 1960s or 1970s, either already rebuilt or still waiting for it.

A listing on this urbanisation will say beachside, and the useful question is what that means on the specific parcel. Under the Ley de Costas the servidumbre de protección runs a hundred metres inland from the inner limit of the shore, and inside the first six metres of it the servidumbre de tránsito keeps a public strip along the coast. On a plot that reaches the sand, those two lines decide what may be built, what may be extended and where a boundary can honestly be drawn. They are not obstacles to be discovered after the arras. They are the first thing a lawyer should establish, because two neighbouring plots on the same street can sit differently against them.

The inland side is settled by a golf course rather than by a road. Río Real, laid out in 1965 to a Javier Arana design, plays more than 6,000 metres from its first tee and separates the housing from the hills behind. That has a practical consequence for a buyer: there is no inland edge to expand into, no strip of unbuilt land waiting for a phase two, and no prospect of the urbanisation growing to absorb demand. So the search is not a search across new supply. It is a search across roughly the same set of plots that has existed since the urbanisation was laid out, waiting for one of them to be offered.

What is actually on the market between the golf and the sand

In practice there are three lists here, not one. There are original villas on large plots, sound but unmodernised, which are bought for the ground and the position. There are the same villas after a full rebuild, sold as finished houses at a finished price. And there are the low-rise apartment communities nearer the sand, which turn over more often and are the only part of this urbanisation with anything resembling a regular supply of listings. Confusing the first two is the standard mistake; ignoring the third is the standard oversight.

The competition differs by list. On the apartments Paula's read is that you are usually bidding against Northern European and Dutch second-home buyers who want a beach they can use in November and are content to drive for everything else. On an unmodernised villa the other bidder may not be a family at all — it may be somebody buying the plot to demolish, who has already priced the rebuild and can move without a mortgage. That bidder sets a floor under tired stock and is the reason a house needing work here rarely trades at the discount a buyer expects.

They carry different marks and different equipment. Establish on the map, not from the particulars, which of them a property actually stands in front of, because the two are frequently described with the same word.

    Map the coastal servitudes onto the plot

    Specific to Marbella

    Ask your lawyer to place the hundred-metre protection strip and the six-metre transit strip on the actual boundary drawing before you discuss any alteration to the house. Where a plot falls inside them, works carry their own consent path, and what a previous owner built is not evidence that it was permitted. This single exercise separates a straightforward beachside purchase from a difficult one.

    Ask where the coastal path lands

    The Senda del Litoral is being assembled in 167 sections from Manilva to Nerja, roughly four fifths of the shoreline is already passable, and more than half of the planned route is to be wider than four metres. Walk the stretch in front of a property and ask the Ayuntamiento what is designed for it, because a completed section changes both the privacy and the footfall of a seaward garden.

    Get the works quoted before offering

    On stock of this age the gap between a house that has been re-serviced and one that has not is the whole negotiation, and it is a builder's question rather than an agent's. Bring someone onto the plot who will price the roof, the wiring, the pool plant and the terraces properly, and treat that figure as part of the offer you are making rather than as a problem for later.

    Match the deed to the building

    Villas of this generation have usually grown: a porch enclosed, a garage converted, a guest room added at the back. Your lawyer sets the Registro entry and the Catastro record against what is standing, and reports the differences in writing before the deposit. Where something is missing from both, the cost of closing that gap belongs in the price rather than in your first year of ownership.

  6. Step 6

    Arras, notary and the handover

    The arras contract carries price, deposit, date and every condition your searches have left open. Completion is the escritura pública signed at the notary with the funds moved that morning. Then comes the part nobody schedules: the utility accounts, the beach-facing garden's irrigation contract and, in an apartment community, the transfer of the owners' association file, which take weeks rather than days.

On top of the agreed figure a resale carries ITP, Andalucía's transfer tax, and a new-build carries IVA plus AJD, with notary, Registro and your own lawyer in both cases. Then allow for the coastal element: salt makes maintenance a recurring line rather than an occasional one, and where a plot sits inside the protection strip, works follow their own consent route. Should I expect to compete with a developer here?

On an unmodernised villa, often. Because the plots are generous and the urbanisation cannot expand, the land itself is the scarce item, and a buyer who intends to demolish values it differently from a family who intends to live in the house. That bidder usually needs no financing and no conditions, which is worth more to a seller than a slightly larger number. If you are buying to live, your advantage is flexibility on the date rather than speed on the price.

Is an apartment here a different purchase from a villa?

Almost entirely. A villa is bought as land, licences and structure, so the work is planning-led and the risks sit in extensions and boundaries. A flat in one of the low-rise communities near the sand is bought on its owners' association: three years of accounts, the last sets of minutes, any resolution on works still to be funded, and the state of the pool plant and the gardens. Both are Los Monteros addresses. They need different questions and, honestly, different advisers.
