The practical work of buying here is done with contour lines rather than a portal filter. Santa María Golf sits at kilometre 1033 of the A-7, its clubhouse inside a nineteenth-century farmhouse, and the residential terraces step up from there through pine and cork oak. Two houses six hundred metres apart can sit a full band apart in price, with a different sea view, a different evening breeze and a different drive to the sand. A viewing list that mixes beachside apartments with upper-slope villas is not a shortlist. It is two searches sharing one name, and treating it as one is the commonest way to waste a trip.
The second piece of work is the shoreline. There is no beach registered under the name Elviria, so a listing that promises Elviria beachfront is describing one of four separately registered strips, each with its own services and its own character. Playa Real de Zaragoza carries the Q de Calidad and has an assisted-bathing point; the chiringuitos in front of it, among them Las Mimosas, Ranchón Cubano and Siroko Beach, set the tone of that particular stretch in August. Walk the one you would actually use, at the hour you would use it, before the price of proximity is agreed.
What is actually for sale on this hillside
Stock here divides three ways. Gated apartment communities sit mostly below the A-7 and around the lower golf approach, with large shared gardens and several pools. Detached villas occupy the terraces above, many of them built between the 1980s and the early 2000s on generous plots, and a good share of them now carrying an extension or two. Plot-only sales exist but are rare, and they are the slowest thing to move.
The buyer pool is deep and international. Marbella's municipal register counts 49,813 foreign residents across a population of 160,478, and the eastern side of the municipality is where a large part of the year-round, school-age half of that number actually lives. In practice you are bidding against Dutch, Belgian, Scandinavian and British families buying a second home they intend to use in more than one season, and against domestic buyers moving out of the town centre for space. That mix keeps the market honest: it is neither purely a holiday market nor purely a residential one, and a house that fails both tests sits.

Step 1
Fix the terrace before the budget
Specific to Marbella
Decide, in writing, whether you are buying below the A-7 or above it. Below means walking to the sand and living with August traffic on the service roads; above means a car for everything and an outlook that holds its value. Name the beach in the file
Specific to Marbella
Ask the selling agent which registered beach the property actually fronts, and get the answer in the file rather than over the phone. Real de Zaragoza, Las Chapas, La Víbora and El Alicate are four different strips with four different service levels, and the walk from a given block to each of them is rarely what a brochure map implies.

Step 3
Nota simple and Catastro cross-check
Your lawyer draws the nota simple from the Registro de la Propiedad and lays it beside the Catastro record. On a hillside plot the two often disagree about the built surface, because terraces, pool houses and carports were added over decades. The gap is not fatal, but it has to be understood and priced before anything is signed.

Inspect the retaining structures
Specific to Marbella
Bring an architect or building surveyor to the terraces themselves. On this slope water travels downhill through several gardens before it reaches yours, and the honest questions are about drainage behind the walls, the state of the pool terrace and who paid for the last repair. That report is worth more than any decorative survey of the interior.

Step 5
Reserve, then arras
A modest reservation takes the property off the market while the lawyer works. The arras penitenciales contract follows, with a deposit and a fixed completion date, and it is the document that decides what happens if either side walks away. Nothing goes into it that your lawyer has not read, and no reservation is paid before the ownership is confirmed.

Step 6
Notary, escritura and registration
Completion happens at a notary in Marbella, which is the notary district for this side of the municipality. Utilities, community accounts and the IBI receipt are settled at the table, and your lawyer lodges the escritura pública at the Registro de la Propiedad afterwards. The keys change hands that day; the registration entry follows within weeks.
Elviria sits in the lower half of the Marbella ladder, below Los Monteros and above Cabopino, and the spread inside the name is unusually wide. On top of the agreed figure, budget for the transfer tax that Andalucía applies to a resale, notary and registry costs, and your own lawyer. Community charges in a gated block here reflect several pools, long private roads and mature gardens, so they sit materially above a plain block in town. Ask for three years of accounts and the minutes of the last two meetings before you commit.

Should I buy above or below the A-7 in Elviria?

It depends on whether you want to walk to the sand or to keep an outlook. Below the motorway you are within reach of the beach and of the service roads that fill in August. Above it you gain plot size, quiet and a sea view, and you accept that a car is needed for bread as well as for dinner. Paula's read is that families who will be here for whole school terms tend to end up above the road, and buyers who come for six weeks in summer end up below it.

Do Elviria villas usually come with licensed extensions?

Often, but not always, and the difference is worth finding before you offer. A large share of the villa stock here dates from the 1980s and 1990s and has since gained a guest annexe, a covered terrace or a second pool. Each of those needs its own licence traced, and the built surface on the escritura compared with the Catastro record and with what you can see on site. Where a discrepancy exists it can usually be regularised, but the cost and the timetable belong in the negotiation rather than in a surprise after completion.

How long does a purchase here normally take?

From accepted offer to notary, six to ten weeks is the usual span for a resale bought without a mortgage, and longer where a Spanish bank is involved. The variable that stretches it in Elviria is documentary rather than financial: an older villa with additions takes time to reconcile between the Registro, the Catastro and the municipal licence file. Paula's practice is to start that reconciliation during the reservation period rather than after the arras, so that the completion date in the contract is one both sides can actually keep.
