The history is unusual enough to matter. Torremolinos was a municipality until 1924, when 446 of its 695 registered residents petitioned Málaga to take it in, and it stayed part of that city for sixty-four years. It became a municipality again on 27 September 1988, by Decreto 283/1988, after a decade of local campaigning. Almost everything built here in the tourism boom therefore has a paper trail that begins in a different town hall — the licence, the first deed, the cadastral entry — and a lawyer who does not know that spends a fortnight looking in the wrong archive.

The other half of the local picture is newer and works in your favour. Torremolinos heads partido judicial number twelve of Málaga province, a district assembled out of the Málaga and Marbella districts and containing only two municipalities, itself and Benalmádena, with five juzgados de primera instancia and five de instrucción sitting in the town. A boundary argument, a community dispute or an enforcement question is therefore heard a few streets from the flat rather than in the provincial capital. For a mortgage that matters less than the archive does, but for the thing people actually fear about buying abroad — what happens if it goes wrong — it matters a great deal.

National law, Andalusian tax, and two town halls in one title

Sort the layers before you sort the problem. The contract, the escritura, the Registro de la Propiedad and the mortgage rulebook are Spanish national law and behave the same here as in León. The transfer tax is Andalusian — ITP on a resale, IVA with the AJD stamp duty on a new unit — set by the regional parliament and therefore never worth quoting from a page. The municipal layer is the Ayuntamiento de Torremolinos: the works licence, the licencia de primera ocupación, the annual IBI and the plusvalía municipal on a sale, all of it under a general plan the town is currently replacing.

What Torremolinos adds is a fourth thing, and it is historical rather than administrative. Because the municipality is younger than most of its buildings, a title chain often crosses an administrative boundary that no longer exists. Ask your lawyer to state, in writing, where the original licence was granted, which registry entry the property first appeared in, and whether the cadastral description was ever brought into line with what was actually built. That last question is also the one a lender's valuer will answer for itself, less generously, if you do not answer it first — undeclared surface on a sixties tower is the commonest reason a Torremolinos mortgage file stops moving without anyone saying so.

  1. Step 1

    NIE before anything else moves

    The NIE is the foreigner's Spanish tax identification number and every later step depends on it: the bank account, the mortgage file, the deed, the utility contracts. Appointments are the constraint rather than the form itself, so start it the week your search becomes serious. If you cannot be present for each stage, give your lawyer a power of attorney at the same time.

  2. Step 2

    Instruct a lawyer who knows 1988

    Specific to Torremolinos

    Tell the lawyer at the outset that the property may predate the municipality. Anything licensed or first registered before 27 September 1988 was processed by Málaga, so the file, the licence and the early registry entries may not be where a routine search looks. Ask specifically for the chain of title across the segregation, and expect that part of the work to take longer than the rest of the search combined.

  3. Step 3

    Reconcile registry, Catastro and reality

    Specific to Torremolinos

    Measure the flat against its own description. In a town built in bursts between the late fifties and the seventies, terraces have been glazed, kitchens moved and units joined, often without a single entry anywhere. Where the registry, the cadastral record and the standing building disagree, somebody has to regularise the difference, and the negotiation about who belongs before the deposit rather than after completion.

  4. Step 4

    Open the mortgage file early

    A Spanish lender assesses you and the property as two separate exercises, and here the property half is the slow one. Give the bank the reconciled registry position and the building's repair history rather than letting the valuer discover them, and start the file before the deposit contract rather than beside it. A cross-border income file also takes longer to evidence than most borrowers expect.

    Arras with the discrepancy priced in

    The arras penitenciales contract fixes the deposit, the date and the consequence of withdrawal. If a surface discrepancy, a pending community works programme or an outstanding mortgage offer is still live, it goes into the contract as a dated condition, together with who pays to put it right. Signing an unconditional deposit contract on a building of this age is where most avoidable losses on this coast begin.

    Notary, registry and the local counter

    Specific to Torremolinos

    The escritura is signed before a notary, who is a public official rather than either side's representative; the transfer tax or IVA with AJD is filed within its window, and the purchase is registered. Afterwards the municipal layer is Torremolinos's own: the IBI, the refuse charge, the plusvalía on the seller's side and any later licence, all of it now handled in the town rather than in the capital.

Two kinds of cost sit on top of the price here, and only one of them is open to discussion. Fixed by statute: the Andalusian transfer tax on a resale, IVA with AJD on a new unit, the notary's tariff, the registry fee, and the plusvalía municipal the seller settles with the Ayuntamiento de Torremolinos. Chosen by you: the lawyer, the survey, the agency arrangement, and — the one that matters in this town — who carries the cost of regularising surface that was built decades ago and never declared. On a sixties tower that item can outweigh everything above it, and it is negotiated in the arras or not at all.

In Málaga, in the first instance. Until 27 September 1988 Torremolinos was part of that municipality, so building licences, occupancy documents and the earliest registry and cadastral entries for anything constructed in the boom years were issued and filed there. Some material has since been transferred and some has not, and the practical answer varies by decade and by document. Instruct your lawyer to ask both administrations rather than assuming the local one holds everything, and allow real time for it in the timetable.

Does a Torremolinos dispute go to Málaga or stay here?

It stays here at first instance. Torremolinos heads its own judicial district, number twelve of the province, shared only with Benalmádena, and the courts of first instance and investigation sit in the town. That is a genuine practical advantage on a coast where files often travel: a hearing about a party wall, a community resolution or an unlicensed enclosure happens locally, with local court staff and local lawyers who already know the building stock. Appeals move up to the provincial level in the usual way.

Why does my Torremolinos valuation come in below the price?

Usually because the valuer is pricing what is registered rather than what is standing. In a stock built quickly between the late fifties and the seventies, enclosed terraces, converted lofts and joined units are common and frequently undeclared, and a Spanish lender attributes no value to surface that does not appear in the registry description. The fix is not to argue with the valuation but to reconcile the paperwork first, which is slow, or to renegotiate on the basis of it, which is faster. Either way the discovery should happen before the deposit.
