Most legal difficulty on a village purchase is not legal at all. It is the distance between what a house physically is and what its registered description says it is, and that gap is a Mijas matter rather than a Spanish one: it is resolved with the Ayuntamiento's certificate of applicable regime, a technician's report and, where needed, a declaration of obra nueva antigua. A lawyer who works this coast will start there. A lawyer instructed only to check charges and read the deed will find nothing wrong and leave you holding a house that cannot be extended, insured properly or resold quickly.

The mortgage side has its own local wrinkle. Spanish mortgage law is uniformly national and unusually protective — the lender's information pack, a minimum ten calendar days before signature, and a free notarial act the borrower must attend no later than the day before the deed. None of that varies in Mijas. None of it changes because you are buying up in the pueblo.

Andalucía governs the transfer tax and stamp duty, which are filed with the Agencia Tributaria de Andalucía, and the tourist-letting regime under Decreto 28/2016. This is the layer that changes when you cross a regional boundary but not when you cross a municipal one.

Mijas governs the rest, and on a village house the rest is the important part: the certificate of applicable regime for the plot, the licence route for any works, the occupancy declaration, plusvalía municipal on a sale and the IBI on the holding. Mijas has three urban districts and keeps its main town hall in the village, with branch offices in Las Lagunas and La Cala, so a Mijas Pueblo owner is nearer this layer than any other owner in the municipality.     Get the NIE and the powers ready

    Every foreign buyer needs a NIE, the Spanish foreigner's identification number, before completion.     Close the municipal file afterwards

    After completion, the municipal side continues: the Catastro record is updated into your name, the IBI account is transferred, and the padrón registration follows if you will live here. Because the main town hall is in the village, these are errands rather than expeditions for a Mijas Pueblo owner. Do them in the first month.

Will a Spanish bank lend on an irregular village house?

Usually, but on the valuation rather than on the price, and the valuation is the uncertain part. Where the registered description does not match the building, some lenders will decline until it is corrected, and correction takes weeks. The practical sequence is: establish the discrepancy, agree with the seller who fixes it and when, and only then set the completion date. Doing it in the other order is how a village purchase collapses in week six.

Do I need a lawyer if I am paying cash here?

More so, not less. A mortgage lender performs its own checks and refuses to lend on a house that fails them, which is an unpaid second opinion. A cash buyer has no such filter and relies entirely on their own lawyer.
