Arroyo de la Miel is a built-out core on a slope, so genuinely new homes appear one plot at a time, usually where an older block has come down. Off-plan here means a small infill building on a known street, not a phase of a resort, and the licence file matters more than the brochure.

The first job on this district is separating the genuinely new from the merely renovated. A great deal of what is marketed as new in an inland core built in the seventies and eighties is a reforma integral: the block stands, the structure is original, and only the interior is recent. That distinction is not cosmetic. A newly built home carries the guarantees of the Ley de Ordenación de la Edificación, including ten-year cover for structural defects, while a refurbished flat in a fifty-year-old building carries the building's own age and the community's own repair history. Establish which one you are buying before anything else is discussed.
The second job is reading the plot. Because there is no land release here, new schemes arrive on sites that were something else, which is why the street around the hoarding matters as much as the floor plan. Check what the neighbouring blocks are, whether the site is on the slope or on the flat, whether the building will have its own garage in a district where parking decides resale, and how the Cercanías halt sits relative to the door. A small infill building answering those four questions well will outlast several fashions in interior specification.
What new building in Arroyo actually looks like
Set expectations by geography. This is the largest of Benalmádena's three cores, laid out on a slope inside a municipality of a little over twenty-seven square kilometres, and it has been continuously built since the coast opened. There is no reserve of developable land behind it in the way there is above the coast road, so new homes arrive singly: a plot released by demolition, an old commercial building replaced, an unfinished corner completed. Programmes are short, unit counts are small, and the promoter is often local.
The municipality's large-scale residential activity is happening elsewhere and should be read as a separate market. On the hillside above the coast, Higuerón West is presented by its developer as a large scheme of apartments and villas with sports and spa facilities, a beach club and coworking attached. That is a serviced resort product with its own buyer, its own service charge and its own price level. It tells you very little about what a small infill block on an Arroyo street will be worth.
The practical consequence for a buyer is that the usual off-plan risks change shape. You are not exposed to a twelve-phase masterplan changing around you; you are exposed to a single promoter, a single licence and a single completion date. That makes the guarantee documents and the licence file the entire due diligence, and it makes the street outside more important than any amenity list.

Establish what is actually new
Specific to Benalmádena
Ask for the declaración de obra nueva and the date of the building, not the date of the kitchen. In this district the honest answer is often that the structure is fifty years old and the flat is two, which changes the guarantees, the community's repair history and the resale story. Neither is worse; they are simply different purchases.

Read the licence at the town hall
Specific to Benalmádena
The Ayuntamiento de Benalmádena runs Urbanismo as its own delegation, with an electronic register for planning submissions. Have your lawyer confirm that the licencia de obra exists for that exact plot, what it permits and what conditions attach, rather than relying on a promoter's timetable. A brochure is marketing; the licence file is the only description of the building that binds anyone.

Step 3
Protect every payment made ahead
Under the Ley 38/1999 regime, as amended by Ley 20/2015, a promoter taking money before completion must hold it in a special account used only for the works and must cover it with a bank guarantee or an insurance policy for the full amount plus legal interest. Do not pay a euro until you hold that document in your name.

Contract the specification, not the render
Attach the memoria de calidades to the private contract, with the completion date, the consequences of delay and the procedure for changes written in. On a small infill building the promoter is often a local company rather than a national group, so the contract and the guarantee are the whole of your protection rather than a formality behind a brand.

Complete the occupancy step
Specific to Benalmádena
Before completion the building has to clear the first-occupation stage with the municipality, which is what allows definitive utility contracts to be signed. Do not accept keys, sign the escritura or release the final payment against a promise that the paperwork is following. In a district where blocks sit close together, the boundary and access conditions are checked at exactly this point.

Take the warranties in writing
A completed new building carries one year of cover for finishes, three years for habitability failures in the installations and ten years for defects affecting the structure, counted from the reception of the works. Collect the policy documents, the as-built drawings and the maintenance manual at handover, because the company that built a single small block may not be easy to find later.

A new home is taxed differently from a resale: IVA on the price and AJD on the deed, instead of ITP, with the rates confirmed by Paula's lawyer in writing rather than quoted from a page. The payment shape differs too, since money goes in stages against a guarantee rather than in one movement at the notary. What is local is the running cost afterwards: a small infill block on an Arroyo street has a lift, a garage and little else to maintain, which keeps the community charge closer to the inland norm than to the serviced hillside schemes above the coast.

Is a gutted 1970s block sold here as new build?

It is often presented that way, and the language is worth challenging. A reforma integral gives you new wiring, new plumbing and a new kitchen inside an original structure, and it comes with the building's own age, its lift, its façade and its community history. Genuine new construction brings the statutory guarantees instead. Ask for the year of construction from the Catastro entry rather than from the listing, and treat the two products as different rather than as better and worse.

Can I buy off-plan at all inside Arroyo de la Miel?

You can, but rarely and in small quantities, because the core has no land left to release. What comes up is an infill building on a plot cleared by demolition, a replacement for an old commercial premises, or a handful of units added above an existing structure. The consequence is that opportunities are occasional rather than continuous, and they are usually sold locally before they are marketed widely. Frequently, yes, and the reason is specific to this district rather than general. Much of the surrounding stock was built without parking and cannot acquire it, so a building that arrives with a garage, a modern lift and current insulation answers three of the standing local objections at once.
