Letting in Arroyo de la Miel: the long tenancy question
Arroyo de la Miel is not a beachfront letting market, and the strongest product here is often a tenancy rather than a nightly stay. Demand comes from people working on the coast who need the Cercanías halt, so the choice between a tourist registration and a long contract is the first decision, not the last.

Begin with your own building. Since Ley Orgánica 1/2025 took effect on 3 April 2025, tourist letting in a property under horizontal division requires the express approval of three fifths of owners representing three fifths of the participation quotas, a source read on 26 August 2026. That rule bites unusually hard in this district, because these blocks are full of people who live in them all year and who vote accordingly. The answer belongs to a specific comunidad de propietarios and not to Arroyo de la Miel as a whole, and two blocks on the same avenue can have resolved it in opposite directions.
Then decide which market you are actually serving. The beach at the bottom of the slope is a three-hundred-metre municipal beach, not a resort frontage, and the strip that draws holiday demand sits four minutes downhill in Benalmádena Costa. What this district has instead is a Cercanías halt on the line between Málaga and Fuengirola, municipal offices, schools and shops that stay open in February. Those things sell a twelve-month contract to a resident far more easily than they sell a summer week, and a home equipped for one is rarely equipped for the other.
The Arroyo season, and the licence position in Benalmádena
The regulatory ground, stated with its date. Andalusian tourist letting runs on Decreto 28/2016: a licencia de ocupación, the technical requirements applicable to housing, a declaración responsable to the tourism authority, entry in the Registro de Turismo de Andalucía and the code in every advertisement. Lettings of more than two continuous months and rural dwellings fall outside it, and a building where three or more units are exploited by the same owner is treated as a tourist apartment establishment instead. Since 3 April 2025 a building under horizontal division also needs a three-fifths community majority. Both sources were read on 26 August 2026.
What that leaves open is the municipal half, and it should be left open. Positions on tourist letting differ from one Ayuntamiento to the next along this coast and are being actively revised, so treat the Benalmádena position as something to confirm in writing, for a specific address, on the day you commit. A confident sentence written in advance is precisely the wrong thing to rely on here.
The season itself is flatter than the shoreline's and that is the district's advantage rather than its weakness. Holiday demand concentrates on the strip below, where the hotels and the marina are; up here the reliable tenant is a person who works on the coast, studies in Málaga or has retired into a town that still functions in February. Since April 2025 a qualified majority can approve or restrict the activity, so what governs you is what your own block resolved and when. In a district of permanent residents this vote is taken seriously and is not a formality, so read it before you buy rather than after.

Andalusian tourist letting rules do not apply to lettings of more than two continuous months, which puts a long tenancy in a different legal world with different obligations and no registration code. In this district the resident demand is real enough that the long contract is often the stronger product, so make this choice deliberately instead of defaulting to a nightly listing.

File and publish the code
If you do let to tourists, the operator files a declaración responsable with the tourism authority before starting, the dwelling is entered in the Registro de Turismo de Andalucía, and the alphanumeric code has to appear in every advertisement in any medium. The property also has to hold a licencia de ocupación, which is a document, not an assumption.

Equip the home to the decree
The decree sets out what a registered dwelling must have: cooling in the bedrooms and living areas in the summer months and heating in the winter ones, a first aid kit, tourist information about the area, official complaint forms, and cleaning at each arrival and departure. Build that list into the refurbishment budget rather than discovering it after the first booking.

Set the changeover around the street
Whichever route you take, the practical limits here are parking and access. Blocks on the main avenues frequently have no garage and a narrow lift, which turns a linen delivery or a family arriving with luggage into a genuine logistical question. Agree with a manager, before the first guest, where a vehicle can stop and how long the stairs add to every turnaround.
A flat here earns steadily rather than sharply. A twelve-month tenancy to a resident fills the calendar and leaves no empty months to absorb, while a nightly operation competes with the hotels and the marina blocks four minutes downhill and gives back much of the difference in cleaning, management and vacancy. Against either route sit the fixed costs: a community charge that does not pause, a lift and a façade that age whether or not anyone is staying, and a manager if you are not here. Which guests actually book a flat away from the beach?

The ones who came for something other than the sand. Families visiting relatives who live here, visitors using the railway to reach Málaga for a few days, workers on short contracts along the coast, and people trying the district before buying in it. That is a smaller and less seasonal audience than the seafront attracts, and it responds to different things: a lift, a parking space, a supermarket downstairs and a short walk to the platform, rather than a terrace facing the water.
