Benalmádena Costa is a finished shoreline, so off-plan here means a single building on a plot something else stood on, not a phase of a masterplan. Two things govern it: the coastal servitudes of the Ley de Costas nearest the water, and the guarantee protecting every payment made before delivery.

Three different products are sold under the word new on this strip, and only one of them is off-plan. The first is a genuinely new building, which arrives singly, on a plot that a hotel, a car park or an older block occupied before it. The second is a flat inside an existing tower, rebuilt behind an original structure — a different purchase, with the building's own age and repair history attached. The third is not on Avenida Antonio Machado at all: it is a scheme on the hillside above the coast, in the same municipality but a separate core, marketed to people searching the seafront by name. Establish which of the three is in front of you before any other question.
The second governing fact is the water. Under the Ley de Costas a strip inland from the shoreline carries a servidumbre de protección, generally a hundred metres and reduced to twenty on land already classified as urban when the law came into force, and a six-metre servidumbre de tránsito runs along the edge itself. On a coastline built out decades ago that has an obvious consequence: the buildings closest to the sand predate the regime, and what may now be done on a plot beside them is a documented question rather than an optimistic one. Have your lawyer obtain the position for the specific plot before the first payment, not after.
What is actually being built on this shoreline
Set expectations by geometry. This is a finished frontage between the water and a slope, with the historic village up on the hill and the working town inland, and no reserve of developable land behind it. New homes therefore arrive one plot at a time, where something else has come down, and programmes are short with small unit counts. The promoter is often a company formed for that one building, which is a different risk profile from a national group and makes the guarantee documents the substance of the transaction rather than the paperwork around it.
The municipality's large residential activity is happening elsewhere and should be read as a separate market. Above the coast, Higuerón West is presented by its developer, Urbania, as more than 750 apartments and villas with a beach club, a sports club and spa membership and coworking attached. That is a serviced product on a hillside in another core of Benalmádena, with its own price level and its own service charge, and it tells a buyer very little about a small block on the avenue. Being clear about which one you are being shown is the single most useful thing on this page.
The practical consequence is that the usual off-plan risks change shape. You are not exposed to a twelve-phase plan changing around you over a decade; you are exposed to one promoter, one licence, one completion date and one coastal servitude position. That narrows the due diligence to four documents and makes each of them decisive.

Read the plot against the coastal servitudes

Guarantee every payment made ahead

Do not transfer a euro before it exists in your name.

Attach the memoria de calidades to the private contract, with the delivery date, the consequences of delay and the procedure for changes written into it. Renders age faster than buildings, and on a small scheme with one promoter the contract is the whole of your protection. Anything agreed verbally on a show terrace has no standing once the building exists.

Take keys only after first occupation
Specific to Benalmádena
The building has to clear the first-occupation stage with the Ayuntamiento de Benalmádena before definitive utility contracts can be signed, and the town hall handling it stands at Avenida Juan Luis Peralta, up in the pueblo rather than on the promenade. Do not sign the escritura, release the final payment or accept keys against a promise that the paperwork is following.

A new seafront block starts with warranties intact and no track record at all. Its first budget is an estimate, its reserve fund starts empty, and its façade, railings and lift machinery are about to meet salt air for the first time. Attend the constitutive meeting, read what the promoter has proposed, and expect the second year's figure to be the honest one.
A new home is taxed differently from a resale: IVA on the price and AJD on the deed instead of ITP, with the rates confirmed by Paula's lawyer in writing rather than quoted from a page.
