Buying in Fuengirola, a town with no land left
Fuengirola is a municipality of 10.36 square kilometres, urbanised almost in its entirety, so buying here means buying resale and almost always an apartment. The question is rarely which district. It is which of the Torreblanca, Los Boliches or terminus halts you can walk to, and whether the block has a lift.

The stock follows the shape of the town. Seven beaches run north to south — Carvajal, Torreblanca, Los Boliches-Las Gaviotas, San Francisco, Fuengirola, Santa Amalia and Ejido-Castillo — and behind each of them sits a band of apartment blocks laid down in a different decade. The seafront towers are the oldest and the most exposed to derramas, the one-off levies a comunidad raises for major works: façades, lifts, garage waterproofing. The blocks two or three streets back are usually younger and quieter, and they lose almost nothing in walking time. A buyer who insists on a sea view is buying a maintenance history as well as a view, and the comunidad minutes are the document that tells you which one.
Who you are bidding against changes by street. Fuengirola holds a resident population of about eighty-five thousand on ten square kilometres, one of the densest municipalities in Andalucía, and a large share of that population is foreign and permanent rather than seasonal. The Finnish school has taught here since 1991, and the Nordic presence around Los Boliches is a settled population, not a holiday one. So you are frequently competing with someone who intends to be in the flat in February, values a lift and a garage above a large terrace, and will pay for both. Buyers who only picture August routinely lose to them, and then wonder why.
What is actually on the market in Fuengirola
Almost everything for sale in Fuengirola is a resale apartment, because the municipality covers 10.36 square kilometres on a coastal strip roughly eight kilometres long and is urbanised almost in its entirety. There is no meaningful supply of villas, no gated golf stock, and very little land on which anything new could be built. The variety that exists is vertical and chronological: sixties and seventies towers on the front, seventies and eighties blocks behind them, and occasional newer infill wherever an older building has come down.
The buyer pool is unusually mixed for a coastal town. Nordic households, Dutch and Belgian second-home buyers, British owners of long standing and Spanish families from Málaga province all shop the same blocks, and a large part of that pool lives here through the winter rather than visiting in the summer. That combination is why lifts, garages and proximity to a Cercanías halt behave like structural value here, while a big terrace does not carry the premium it would on a hillside further west.

Choose the halt before the flat

Fuengirola is the terminus of the Cercanías C-1 from Málaga, and Torreblanca and Los Boliches are halts in their own right. Walk the route from the door to the platform at the time of day you would actually use it. Six minutes and sixteen minutes are different properties, and the difference is permanent because no new track is coming.

Read three years of comunidad minutes
Specific to Fuengirola
Seafront blocks from the nineteen-sixties and seventies reach façade, lift and garage works at roughly the same age, and the levy usually lands on whoever owns the flat when the vote passes. Ask for three years of minutes, the reserve fund position and any works already agreed but not yet billed, before you sign arras rather than after.

Take the nota simple early
The nota simple from the Registro de la Propiedad shows the registered owner, the described surface and any charge, embargo or mortgage against the property. It is cheap, it takes a day, and it is the only document that tells you whether the person offering the flat can actually sell it. Order it before you spend money on anything else.

Price the parking separately
Specific to Fuengirola
Street parking near the promenade is scarce all year and effectively gone in August, so a deeded space is treated here as part of the property rather than a convenience. Check that the space appears on the nota simple as a finca or an annex with its own reference, and not merely as an informal allocation the comunidad could withdraw.

Agree arras with a survey condition
Arras penitenciales fix the price and the timetable and put a cost on walking away, so write the condition you actually need into them: a technical inspection of the block, the comunidad certificate confirming no debt, and the licence position for anything that has been altered. A clean deposit contract is the cheapest protection you will buy.

Sign before the Fuengirola notary

That keeps the notaries, the court and the registry local and short-distance, which matters when a document has to be corrected between arras and escritura. Reserve a notary date once the bank and the lawyer both confirm the file is complete.

On top of the agreed price a resale purchase carries Andalucía's transfer tax, ITP, while a new-build unit is IVA plus AJD instead; the rates change, so Paula's lawyer confirms the current ones in writing before you commit. Add notary and Registro de la Propiedad fees, your own lawyer, and in Fuengirola two costs that are easy to forget: a deeded parking space is usually a separate line rather than an inclusion, and a block of this age can carry an agreed derrama that transfers with the flat. Ask for the comunidad certificate and the pending-works position before the deposit, not after it.

How do I check a Fuengirola block for pending derramas?

Two documents, both obtainable before you commit. The comunidad certificate states whether the flat is up to date with its charges, and the administrator issues it. The minutes of the last three annual meetings show what has been voted, what is being tendered and what is being argued about. In a seafront block of this age the second document matters more than the first: a levy for a façade or a lift can be agreed before completion and land on you afterwards. Read both, and have your lawyer put the position in the arras contract.

Is Los Pacos a realistic alternative to the Fuengirola seafront?

For a full-time household, often yes. Los Pacos Norte and Los Pacos Sur are among the neighbourhoods the Ayuntamiento assigns their own councillor, which is a fair sign of how the town organises itself away from the promenade. The stock there is generally younger than the front, parking is less of a daily negotiation, and the beach is a walk rather than a doorstep. What you give up is the view and the letting demand that comes with it. Walk it in February as well as in August before deciding.
