Letting in Fuengirola, a town with two rental calendars

Fuengirola lets on two calendars at once: short summer stays along the promenade, and long winter months taken by northern Europeans who could as easily be tenants as guests. Which one you choose decides the licence regime, because a let of more than two continuous months falls outside the Andalusian tourist rules.

The winter half of the calendar is what makes this town unusual. Most of the coast plans for a short, intense summer and a dormant autumn; Fuengirola has an international population that is here in January, a Finnish school that has been running since 1991, and shops and restaurants that stay open because residents need them. A flat with heating, glazing and a lift can be let by the month from October to April to a guest who wants a base rather than a holiday. That is a different product, a different contract and, above two continuous months, a different legal regime altogether.

The summer half is constrained by something very physical: the town is one of the densest municipalities in Andalucía, with over eight thousand residents per square kilometre, and street parking near the seafront disappears in August. A guest arriving by hire car and finding nowhere to leave it will say so in writing. The counterweight is the Cercanías C-1, which terminates in Fuengirola and stops at Torreblanca and Los Boliches, so a flat within a short walk of a platform can be let to guests who never rent a car at all. Say that in the listing; it filters for the right guest.

The Fuengirola season, and the licence position in the municipality

Take the regulation first, because it is the part that dates. Andalusian tourist letting runs on Decreto 28/2016, de 2 de febrero: a licencia de ocupación, the technical standards applicable to housing, a declaración responsable to the tourism authority, entry in the Registro de Turismo de Andalucía and the registration code in every advertisement. The same decree excludes lettings of more than two continuous months to one tenant. Separately, since 3 April 2025 a building under horizontal division needs three-fifths community approval under the Ley de Propiedad Horizontal. Both sources were read on 26 August 2026.

What no page can responsibly tell you is what the Ayuntamiento de Fuengirola will grant for a specific address. Municipal positions along this coast differ and are being revised — new licences are reported suspended in Marbella municipality — so the only safe instruction is to obtain the town hall's position in writing, for your street, on the day you commit. The season itself is genuinely two seasons. Summer nights along the seafront behave like the rest of the coast. The months from October to April behave like a residential market, because a large part of Fuengirola's international population lives here rather than visits, and because the trains, the shops and the schools keep running. Owners who equip only for August are competing for the smaller half of their own year.

  3. Step 3

    Get the community position first

    Since 3 April 2025 the Ley de Propiedad Horizontal requires express approval by three fifths of owners representing three fifths of the quotas before tourist letting can begin in a building under horizontal division. Almost every Fuengirola flat sits in such a building, so read the statutes and the recent minutes before you buy, not after the sale completes.

  4. Step 4

    File and publish the code

    Under the decree the operator files a declaración responsable identifying the dwelling, the owner and the form of exploitation before starting. Entry in the Registro de Turismo de Andalucía follows, and the resulting registration code must appear in every advertisement. Keep the filing, the code and the licencia de ocupación together with the title deeds, because a future buyer will ask for all three.

    Solve parking before the first booking

    In a municipality with over eight thousand residents per square kilometre, guest parking is the operational problem that generates the worst reviews. Either the flat has a deeded space you can allocate, or the listing says plainly that it does not and points guests at the train instead. Ambiguity here costs more than a lower nightly rate ever would.

    Equip the flat for February

    Specific to Fuengirola

    The winter guest here is a resident in miniature: they cook, they work, they need heat and hot water and a table. Effective heating, decent glazing, a working lift and reliable connectivity decide whether a flat participates in the October-to-April market at all. Air conditioning matters for eight weeks; heating decides six months of the calendar.

A Fuengirola flat earns in two shapes rather than one. Summer nights are the visible half; the quieter half is a run of winter months at a monthly figure, which is lower per night but almost costless to service and far kinder to the building. The homes that perform are the ones with heating, a lift and either a deeded parking space or an honest listing that points guests at the train. Against that, management in a dense town means changeovers on streets with nowhere to stop. Ask Paula what comparable flats are actually achieving before you model anything.

Should I let a Fuengirola flat by the night or by the month?

Often both, on different halves of the year, and the split is what makes this town workable. Summer suits nightly letting under the tourist regime with a registration code shown in the advertisement. October to April suits monthly stays for the northern-European residents who are here anyway. Can guests reach my Fuengirola flat without hiring a car?

If the flat is within a short walk of Torreblanca, Los Boliches or the terminus, yes — the Cercanías C-1 runs from Málaga and ends in this town, which is unusual on a coast where most destinations are a road journey. That is worth stating explicitly in the listing, because it removes the parking problem for the guest and for you. Flats further from a platform can still let well, but they should be honest about the car and about where it goes in August.
