Knowing which layer a question belongs to saves weeks. If the question is about arras, the escritura, the Registro de la Propiedad or the mortgage offer, the answer is the same in Fuengirola as in Bilbao, and a lawyer anywhere in Spain can give it. If the question is about the tax on the purchase, the answer is set for the whole of Andalucía and changes when the region decides it does. Only when the question touches the plusvalía on a sale, the IBI on the property, a building or occupancy licence, or the local street itself does the Ayuntamiento de Fuengirola actually enter the conversation.

When something has to be corrected between the deposit contract and the deed — a surface that does not match, a charge that has not been cancelled — that compactness turns a fortnight into an afternoon.
National, Andalucían and Fuengirola — which is which
National law governs the shape of the transaction: the contract, the deed, the property register, and — for mortgages — Ley 5/2019, which requires the lender to hand over the FEIN and the standardised warnings sheet at least ten calendar days before signing and requires the borrower to attend a free notarial acta no later than the day before the mortgage deed. Those rules are identical in every Spanish municipality and are not negotiable by a bank in a hurry.
Andalucía sets the tax on the transfer: ITP on a resale, IVA plus AJD on a new-build unit. Rates are a regional decision, they change, and no page should print them. The municipal layer is genuinely Fuengirola's: plusvalía municipal on a sale, the IBI bill, refuse charges, and the building and first-occupation licences that pass through the town hall. The town also heads its own partido judicial, number five of Málaga province, shared only with Mijas — so the courts, notaries and registry that handle your file are local, which is why corrections here are usually measured in days rather than weeks.

Step 1
Get the NIE before anything else
The NIE is the foreigner's tax identification number, and nothing meaningful happens without it: no bank account, no mortgage file, no deed, no utility contract. Apply early, either in Spain or through the Spanish consulate in your own country, and give your lawyer a power of attorney if you cannot be present for each step. Delay here delays everything downstream.

Appoint a lawyer who is yours
The notary is impartial and the agent acts for the transaction. Neither is your adviser. Instruct an independent lawyer to run the nota simple, the charges, the comunidad position and the licence status, and to draft or review the arras before you sign it. In a market of older blocks like Fuengirola's, most of what goes wrong is discoverable in advance and cheap to check.

Take the ten days seriously
Ley 5/2019 requires the lender to deliver the FEIN, the FiAE, the draft contract, the cost allocation and the insurance conditions at least ten calendar days before signing. That period is yours to use, not a formality. Read the standardised warnings sheet with your lawyer, and query anything about rate index, early repayment or currency before the clock runs out.

Attend the free notarial acta

Before a mortgage deed can be authorised, the borrower must appear before a notary no later than the day before, for an impartial explanation and a check that the ten-day rule was met. The acta carries no notarial fee. In Fuengirola this is a short walk rather than a journey, because the notaries serving the district are in the town itself. Do not treat it as a formality to be delegated.

Step 5
Sign the deed and register it
At the escritura the notary identifies the parties, reads the deed, records the payment and issues the copies. Registration at the Registro de la Propiedad follows, and it is registration rather than signature that makes your ownership good against third parties. Confirm with your lawyer who is lodging the deed, when, and how you will receive proof that it has been done.

Move the municipal accounts across
Specific to Fuengirola
After completion the municipal layer becomes yours: the IBI bill issued against the property, the refuse charge, and the cadastral record that should now show your name. Have your lawyer notify the Ayuntamiento de Fuengirola and set up direct debits, and keep the plusvalía settlement from the seller's side in your file — a future buyer's lawyer will ask about it.
Some of these costs are fixed by law and some are negotiable, and it is worth knowing which is which. The notary tariff and the registry tariff are set nationally. ITP or IVA plus AJD is set by Andalucía and is not open to discussion. Plusvalía municipal is calculated by the Ayuntamiento de Fuengirola on the land value and the holding period. What you can actually negotiate is your lawyer's fee, the lender's arrangement charge, the valuation, and the allocation of costs between the parties in the arras. The notarial acta before a mortgage deed carries no fee at all — if someone bills you for it, ask why.

Can I sign a Fuengirola purchase without travelling to Spain?

For the purchase itself, usually yes, through a power of attorney granted to your lawyer and legalised for use in Spain. For a mortgage, no: Ley 5/2019 requires the borrower to appear personally before a notary no later than the day before the deed, so that the notary can confirm the disclosure period was respected. What is genuinely open is the split of costs between buyer and seller in the arras, your own lawyer's fee, the lender's charges and the valuation, and whether a pending comunidad levy is met by the seller.
