Fuengirola · New build & off-plan

Off-plan in Fuengirola, where new build means replacement

In a municipality of 10.36 square kilometres that is already built out, new build in Fuengirola almost always means replacement: an older building comes down and a newer, better-specified one goes up on the same plot. That changes what you are buying, and it changes which guarantees you should be asking for.

Replacement building behaves differently from greenfield development, and the difference is worth understanding before you reserve anything. On a plot inside a town of eighty-five thousand people, the site is surrounded on every side by occupied buildings, the access for machinery is a public street, and the programme is exposed to municipal timetables in a way a hillside site is not. That tends to make schedules longer and the tolerance for slippage smaller. It also means the finished block sits inside an established street pattern rather than a phase-two masterplan, so what you see around it on the day you view is broadly what you get.

The compensating advantage is that the surroundings are already known. There is no phase two to be built beside you, no unbuilt clubhouse to wait for and no urbanisation still to be adopted by the Ayuntamiento — the roads, the drains and the lighting outside the door have been there for decades. In a town where 10.36 square kilometres are urbanised almost in their entirety, that certainty is the real product. What you are underwriting is the developer, the specification and the paperwork, not a promise about how the neighbourhood will turn out.

What is under construction in Fuengirola, and what is not

The honest starting point is scarcity. Fuengirola occupies 10.36 square kilometres of narrow coastal strip and is urbanised almost in its entirety, so there is no land bank, no golf-valley extension and no hillside release of the kind that produces large off-plan schemes further west. Anyone who tells you there is a steady pipeline of new development inside this municipality is describing a different town. Paula will tell you plainly when the honest answer to a new-build brief in Fuengirola is that the thing you want does not currently exist here, and where on the coast it does.

What does happen is replacement and infill: individual plots where an older building is demolished and a new block is licensed in its place, usually small, usually well specified, and usually sold before it is finished. That kind of scheme is worth taking seriously, but it must be underwritten on the developer and the documents rather than on a masterplan, because there is no masterplan. The licence, the guarantee for your deposit, the special account and the first occupation licence are the whole of the protection, and each one is verifiable before you pay.

How this runs, step by step

  1. Step 1

Confirm the licencia de edificación exists

    Specific to Fuengirola

The obligation to guarantee your money starts from the moment the developer obtains the building licence, so the first question is whether that licence has actually been granted by the Ayuntamiento de Fuengirola for this plot. A reservation taken before the licence exists is a reservation without the statutory protection behind it. Ask to see the licence, not a summary of it.

    ↗
  2. Step 2

    Demand the guarantee in writing

Spanish law requires the developer to secure the return of every advance payment plus legal interest, through an insurance caution contract or a solidary bank guarantee, and to name the insurer or guarantor in your contract. Read the wording, check the amount covered matches what you will actually pay in, and keep the original document rather than a scan sent by the sales office.

    ↗
  3. Step 3

Check the special account, not the transfer

Advance payments must be received through a credit institution and deposited in a special account, kept separate from every other fund belonging to the developer and drawn on only for construction. If the payment instructions point at an ordinary company account, that is not a detail to argue about later. It is the reason to stop and take advice before transferring anything.

    ↗
  4. Step 4

Price the neighbours into the programme

    Specific to Fuengirola

A replacement site in Fuengirola is worked between occupied buildings on streets where parking is already scarce, which constrains deliveries, hours and the sequence of works. Ask the developer how the site is accessed, what the agreed working hours are, and what the contingency is if the municipal schedule slips. A programme that assumes an empty site is a programme that will move.

  5. Step 5

Wait for the first occupation licence

    Specific to Fuengirola

The licencia de primera ocupación is the municipal document confirming the finished building matches what was licensed and may be lived in. Utilities, mortgages and any future tourist registration all lean on it. Completion should be structured so that you sign the escritura with that licence in hand, and your lawyer should say in writing what happens if it is delayed.

  6. Step 6

    Register the ten-year cover

The Ley de Ordenación de la Edificación requires insurance covering material damage to the building for ten years where the cause lies in the foundations, supports, beams, floor structures, load-bearing walls or other structural elements. Get the policy number and the insurer into your file at completion. It follows the building rather than the first owner, so it matters again when you sell.

    ↗

An off-plan purchase costs on a different calendar from a resale. You commit a reservation, then staged payments through construction, then the balance at the escritura, and new-build units carry IVA plus AJD rather than the transfer tax that applies to resale. The rates change and your lawyer confirms them in writing before you commit. What matters more in Fuengirola than the split itself is that every staged payment is covered by the developer's guarantee and lands in the special account. Money paid outside that structure is money you are lending unsecured to a builder, whatever the brochure calls it.

Questions about this in Fuengirola

Is there any genuine off-plan supply inside Fuengirola itself?

Very little, and it is worth saying so plainly. With the municipality urbanised almost in its entirety, what appears is occasional replacement of an individual building rather than a pipeline of schemes. Buyers who want a large modern development with communal gardens and a phased masterplan are usually looking at the municipalities either side, not at Fuengirola. Paula would rather tell you that at the first conversation than walk you around three resales pretending they are the same product.

↗

What protects my deposit if the Fuengirola developer fails?

Two mechanisms, both statutory and both checkable before you pay. From the moment the building licence is granted, the developer must guarantee the return of every advance payment plus legal interest through an insurance caution contract or a solidary bank guarantee, naming the insurer or guarantor in your contract. Separately, those payments must be received through a credit institution into a special account, separate from all other company funds and drawn on only for the construction. Verify both documents before the first transfer, not after.

↗

Does a Fuengirola replacement block have any resale advantage?

Often, yes, and for an unglamorous reason. The town's existing stock is dominated by blocks from the nineteen-sixties and seventies that are now reaching façade, lift and garage works together. A recently completed building carries a ten-year structural cover, modern insulation and, usually, a fully funded reserve from the start, which is exactly what the winter-resident buyer here is screening for. The scarcity of new supply then works in your favour on the way out as well as on the way in.
