Letting in Sotogrande Alto: a lease, not a licence

Most homes above the A-7 are let on an ordinary residential lease rather than to holidaymakers, because the tenant who wants ten months on this hillside already exists. That makes Sotogrande Alto the one part of the estate where the tourist-licence question is often the wrong question to start with.

Letting here starts with a choice between two different legal products, and most owners above the road make it by accident. A long residential lease is governed by the Ley de Arrendamientos Urbanos, needs no tourism registration, runs for months rather than nights and produces one set of keys and one contract. A tourist let is a registered activity with its own regime, its own advertising rules and, in a gated sub-community, its own politics. Both are legitimate. They are simply not the same business, and the furniture, the insurance, the management contract and the tax treatment all follow from which one you chose.

The second thing that separates the upper estate from the seaward half is that a good part of its stock sits inside gated schemes of townhouses and apartments, which the original ground does not have. Those are comunidades de propietarios, so the neighbours' vote on tourist letting genuinely applies — the exact opposite of a villa standing alone on its own plot. If you own in one, read the minutes before you furnish anything. The upper estate does not really have a season in the coastal sense. Its calendar is an academic year with golf around the edges: families in residence from September to June, visiting members and tournament weeks in spring and autumn, and a high summer that matters less here than it does two kilometres down the hill. That shape is why the long lease is the natural product above the road and the short let is the exception rather than the default.

Where an owner does want to let short, three things have to line up, and as at 26 August 2026 all three are moving. That makes storage, a utility room, a desk and heating that actually works in January worth more than a show kitchen. The hillside sits under cork oak and holds damp; a house that is charming in August can be bleak in February. Check the boiler, the gutters and the leaf fall before the first tenancy, not during it.

    Decide who gets the golf weeks

    Spring and autumn bring golf demand around Valderrama and Almenara's twenty-seven holes, and those are the weeks an owner is most tempted to keep. A long lease removes them entirely: the house is the tenant's and you are a guest in it. Settle that before the contract is drawn rather than discovering it when a tournament week comes round and the keys are not yours.

A ten-month lease on this hillside trades a lower weekly rent for far more weeks of it, and it produces a flatter, more predictable line than anything the shoreline offers. A tourist let does the reverse and competes against homes a guest can walk from, which the upper estate cannot offer. Against either sit costs the coast does not carry: a wooded plot's gardener, a pool through the winter, real heating in January, the estate conservation charge and, in a gated scheme, a second charge below it. Do I need a tourist licence for a ten-month tenancy?

No. A lease of that length is a residential tenancy under the Ley de Arrendamientos Urbanos, not a tourism activity, so the Andalucían tourist-home register is the wrong door. What it does need is a properly drafted contract, a deposit lodged as the law requires and a clear position on utilities and garden maintenance.
