Torrox is not short of ground, which surprises people who have only seen the promenade. The cadastre records 3,897 built urban parcels in the municipality and 916 still vacant, so a reservoir for infill exists. Where those parcels actually lie is the first thing to establish about any specific scheme, because the front around the lighthouse reads as finished, and ground behind the old coast road is a different proposition from ground on it. A building on the slope sells a view and a garage; a building inside the strip sells a walk to the sand with a traffic question attached. They are not interchangeable, and a brochure that treats them as one is telling you something.
The second question on a shoreline strip is one that inland areas never have to ask. Ley 22/1988 draws a servidumbre de protección inland from the public maritime-terrestrial domain, and its width is not the same everywhere — land already classified as urban when the Act came into force carries a narrower band than land that was not. On a settlement built at the water's edge, that line runs straight through the development question. Before any deposit, have your lawyer obtain the deslinde position for that exact plot and what the servidumbre permits on it, because it is a state and regional matter rather than a municipal one, and it is not settled in a sales office.
What actually gets built on the Torrox strip
Set expectations by counting. The municipality covers 50.02 square kilometres and the cadastre records 3,897 built urban parcels against 916 vacant ones, which is enough ground for continuous small-scale building and nowhere near enough concentration for a masterplanned resort. What that produces is infill: a plot released by demolition, an unfinished corner completed, a small block replacing an older commercial building. Programmes are short, unit counts are low, and the promoter is frequently a local company with one site rather than a national group with twelve.
That changes the risk rather than removing it. You are not exposed to a twelve-phase plan shifting around you over eight years; you are exposed to one promoter, one licence and one delivery date. So the guarantee documents and the licence file are not paperwork around the purchase — they are the purchase. Paula's read is that on this strip the new-build premium is only worth paying where the building answers something the older stock cannot: a lift, a garage, insulation, a unit sized for living in rather than for a fortnight. Where it offers a newer kitchen inside the same plan, the resale market will not repay it.

Step 1
Locate the plot against the coast
Specific to Torrox
On a strip built at the water's edge the first search is not the floor plan. Ask your lawyer for the deslinde position of the plot under Ley 22/1988 and what the servidumbre de protección permits there, and get it in writing before any reservation is signed. A promoter's confidence is not a substitute for the file, and the answer is not the town hall's to give.

Step 2
Separate a new build from a refit
A good deal of what is marketed as new on this coast is a refurbished flat inside a block from the seventies. That is a legitimate purchase and it is a different one: a newly built home carries the structural guarantees of the Ley de Ordenación de la Edificación, while a refit carries the building's own age, its community and its repair history. Establish which is on offer before anything else is discussed.

Step 3
Read the licence file, not the brochure
Specific to Torrox
Under Ley 7/2021, article 137 sets out what needs an express municipal licence and article 140 how it is granted, while article 138 lets certain acts proceed on a declaración responsable instead. The framework is Andalusian; the decision belongs to the Ayuntamiento de Torrox. Have your lawyer confirm that the licencia de obra exists for that plot, what it permits, and what conditions attach.

Step 4
Guarantee every staged payment
Under the Ley 38/1999 regime as amended by Ley 20/2015, a promoter taking money before delivery must hold it in a special account used only for the works and cover it with a bank guarantee or an insurance policy for the full amount plus legal interest. Do not transfer a single payment until that document exists in your own name.

Contract the specification and the date
Attach the memoria de calidades to the private contract, with the delivery date, the consequences of delay and the procedure for changes written into it. On this strip the promoter is often a small local company rather than a national group, which makes the contract and the guarantee the whole of your protection rather than a formality behind a recognisable brand.

Step 6
Wait for the first-occupation licence
Specific to Torrox
Before completion the building has to clear the first-occupation stage with the municipality, which is what allows definitive utility contracts to be signed. Do not accept keys, sign the escritura or release the final payment against a promise that the paperwork is following. On a plot squeezed between existing blocks, access and boundary conditions are examined at exactly this point.
A new home is taxed differently from a resale: IVA on the price and AJD on the deed instead of transfer tax, at rates Paula's lawyer confirms in writing rather than quoting from a page. The shape of payment differs too, since money leaves in stages against a guarantee rather than in one movement at the notary. What is local is the comparison afterwards. New units on this strip sit inside a deep market of standardised older flats, so the premium has to be justified by something structural — a garage, a lift, insulation — rather than by finishes alone.

Are new blocks here specified for holidays or year-round living?

Both exist, and the difference is worth more than the finishes. Much of the strip's older stock was built small for a fortnight in August: one bedroom, a shower room, little insulation and no lift. A new building that adds a lift, a garage, proper insulation and a unit somebody could work and winter in is answering a real gap in this market. One that repeats the old plan with a better kitchen is competing against hundreds of cheaper flats a street away.

Is buying new worth it against Torrox Costa's resale stock?

Only where the new building does something the old one cannot. This strip has a deep, standardised resale market, so a valuer and a future buyer will both compare your new flat against it. A garage where parking is the daily argument, a lift in a four-storey block, insulation that changes the winter — those hold their premium. A newer kitchen inside the same layout does not, and that is where most of the disappointment about new build on this coast comes from.
