On a strip full of German-speaking winter residents, choosing the wrong shape is the common and expensive error.

The decision that shapes everything else here is which regime you are letting under. As at 27 August 2026, Andalusian tourist letting runs on Decreto 28/2016, which requires a licencia de ocupación, a declaración responsable to the tourism authority, entry in the Registro de Turismo de Andalucía and the resulting code in every advertisement — and which expressly excludes a letting of more than two continuous months to the same tenant. A German or Dutch guest who arrives in November and leaves in March is therefore not a tourist let at all. That distinction is not academic on this strip, because the long winter stay is one of the two things Torrox actually sells.

The second constraint sits inside your own building. Since 3 April 2025 the Ley de Propiedad Horizontal has required express approval by three fifths of owners representing three fifths of the quotas before tourist letting begins in a building under horizontal division — and Torrox Costa is almost entirely such buildings. In a block where a large share of the owners live here through the winter rather than visiting for a fortnight, that vote is a real question rather than a formality. The Torrox season, and the licence position as at August 2026

Take the regulation first, because it is the part that dates. As at 27 August 2026, Andalusian tourist letting is governed by Decreto 28/2016, which sets the technical requirements, the declaración responsable, entry in the Registro de Turismo de Andalucía and the obligation to quote the registration code in advertising, and which excludes a let of more than two continuous months to the same tenant. Since 3 April 2025 the Ley de Propiedad Horizontal has also required three-fifths approval by owners and quotas before letting begins in a building under horizontal division. Both were read on 27 August 2026, and neither substitutes for the municipality's own answer about a specific address.

The season itself is unusual for this coast. Torrox has seven hotels with 1,437 places for a municipality of 21,795 residents, so private flats carry the overnight demand, and the municipality's economy is described as resting fundamentally on the sale and letting of holiday and second homes. Two guests fill the year between them: the domestic Spanish summer, concentrated and loud, and the northern-European winter stay, long, quiet and legally different. Very few addresses can serve both well without being equipped for both, and none of them manage it by accident.

    No page can tell you what a specific town hall will permit at a specific address, and municipal positions along this coast differ and are being revised. Put the question to the Ayuntamiento de Torrox in writing, for your own street, on the day you commit, and keep the reply.     Solve the arrival and the parking

    Specific to Torrox

    Guests reach Torrox Costa by road: there is no Cercanías service east of Málaga city, so almost everyone arrives with a car or a booked transfer. That makes two answers non-negotiable in your listing — exactly where the car goes, and how the party crosses the old coast road with luggage. Ambiguity on either point produces the reviews this strip generates most often.

    Equip for a winter tenant

    Specific to Torrox

    A flat let for a fortnight and a flat let for a winter need different things. The winter guest wants heating that works in a concrete block, hot water that copes, storage for a season's belongings, a table to work at and a connection that does not drop. Specify for that and the summer let is comfortably covered as well. The reverse is not true, and it shows in the reviews.

What a home like this earns is a function of how many months it is occupied rather than of a headline week. A flat that takes the Spanish summer and then a long winter tenant works across far more of the year than a beach-only address further west, though the winter months earn at a much lower intensity and under a different contract. What erodes the result is local and predictable: standing charges through a quiet spring, a share of a fifty-year-old block's repair programme, and the cost of servicing arrivals that all come by road. Does a four-month winter let need a tourist registration?

Not under the tourist decree, no. As at 27 August 2026, Decreto 28/2016 expressly excludes a letting of more than two continuous months to the same tenant, so a stay from November to March sits under ordinary tenancy law rather than in the tourist register. That changes the contract, the notice regime and the tax treatment, and it changes what your neighbours may object to. Is heating a real requirement for a Torrox winter guest?

Yes, and it is the most common gap on this strip. Blocks here were built for August, so heating, hot-water capacity and insulation are frequently an afterthought in flats that are otherwise perfectly good. A guest who has come from northern Europe for four months will notice a cold tiled floor in January long before they notice a dated kitchen. Specify heating you would live with yourself, and state plainly in the listing what the flat actually has.

Where do my guests park on the old coast road?

Answer that in the listing or expect it in the reviews. Torrox Costa was laid out along the old coast road, which is simultaneously the strip's high street and its through route, and there is no Cercanías service east of Málaga city, so almost every guest arrives by car. Name the arrangement precisely — private space, garage, street, or none — and describe the crossing from the car to the door with luggage. Vagueness here reads as concealment.
