Start in the minute book. The Ley de Propiedad Horizontal now lets three-fifths of owners, representing three-fifths of the participation quotas, approve, limit, condition or prohibit the tourist letting referred to in the urban leases law, and that power has been in force since 3 April 2025. In a hillside made almost entirely of gated phases from the 1990s and 2000s, that is not a theoretical clause — it is a decision that may already have been taken in a building you are about to buy into. Ask for the last two sets of minutes and read them for this specific item before you commission photographs or price a calendar.

Underneath sits Decreto 28/2016, which governs tourist homes on residential land in Andalucía, requires a declaración responsable and registration with a code shown in all advertising, and excludes some arrangements — a stay of more than two continuous months to the same guest, or three or more dwellings of one owner in a single building. As at 26 August 2026 that is the framework; confirm it before you commit.

Equip for golfers, not sunbathers

A home on this hillside earns its reviews on things a beach apartment never needs: somewhere secure and dry for clubs and shoes, a driveway a buggy or a hire car can use, a washing machine that copes with four sets of golf clothing a day, and clear information on booking a tee time. Get those right and the same guests rebook, which on a golf slope is most of the business.

Gated phases have their own rules on key handover, visitor parking, pool hours and who may pass the barrier. Agree the arrival procedure with the administrator in writing before the first booking, and put it in the guest instructions. Most disputes between an owner who lets and a community that would rather not start at the gate rather than with the noise.

Build the calendar around play
Specific to Benahavís
Open and price the year for autumn and spring rather than for high summer, and expect mid-week demand as well as weekend. Hold the weeks when the course is at its best and the descent to the valley is quickest, and treat August as the month to use the house yourself. A calendar copied from a beachfront listing will leave the strongest weeks on this slope underpriced.
A home on this slope earns its best weeks when the golf is comfortable rather than when the sea is warm, which puts the strong stretch in autumn and spring and makes August the month to keep for yourself. Mid-week demand is real, so the calendar fills differently from a beachfront one. Against that, the community budget on a gated hillside phase is heavier, guests expect a standard set by the hotel next door, and the golf itself is booked and paid separately. Does the resort hotel take the guests I want?

It competes for them, and it also creates them. A resort on the same slope brings players to this hillside who would otherwise have booked a different course, and some of them return the following year wanting a kitchen and four bedrooms instead of two hotel rooms. What it genuinely does is fix the service benchmark: guests who have stayed there expect the linen, the cleaning and the responsiveness of a hotel. Owners who match that on the practical points hold their rate; owners who do not compete on price alone.
