Letting on a shoreline where the competition has a reception desk

Benalmádena Costa is a holiday shoreline first, so a flat here lets to visitors rather than to residents and competes with the hotels standing beside it. Two questions come before any listing: what your own comunidad de propietarios has resolved, and what the Andalusian registration regime requires of the dwelling itself.

Begin inside your own building, because the answer is not a municipal one. Since Ley Orgánica 1/2025 took effect on 3 April 2025, tourist letting in a property under horizontal division requires the express approval of three fifths of owners representing three fifths of the participation quotas — a source read on 26 August 2026. On this strip that vote is genuinely unpredictable. Communities here mix owner-occupiers with flats let by the night, and two blocks on the same stretch of Avenida Antonio Machado have resolved it in opposite directions. Inside Puerto Marina the same meeting is also carrying obligations for quays and structures standing in water, which changes the temperature of the room.

Then look at who you are actually bidding against. Benalmádena Costa concentrates the bulk of a municipal hotel plant of almost thirteen thousand beds, and those beds are on the same shoreline, selling the same view, with a reception desk and a discount in the quiet months. A flat does not win that fight on price. It wins on the things a room cannot supply: separate bedrooms, a kitchen, a terrace, a parking space, and a stay long enough that unpacking is worth it. The season on this strip, and the licence position in Benalmádena

The regulatory ground, stated with its date. Andalusian tourist letting runs on Decreto 28/2016: a licencia de ocupación, technical requirements covering ventilation, darkening, cooling and heating, a declaración responsable to the tourism authority, entry in the Registro de Turismo de Andalucía and the registration code in every advertisement, with guests identified on arrival so the entry documentation can be completed. Lettings of more than two continuous months to the same user fall outside it. Since 3 April 2025 a building under horizontal division also needs a three-fifths community majority. Both sources were read on 26 August 2026.

The municipal half is deliberately left open. The Ayuntamiento de Benalmádena published no dedicated notice on tourist letting on its own site as at 26 August 2026, and positions elsewhere on this coast differ and are being actively revised. Treat the municipal answer as something to obtain in writing, for a specific address, on the day you commit. Nothing on this page states what any given flat will be granted.

The season itself is concentrated and it is contested. Demand arrives with the visitor rather than with a resident, so the strongest weeks sit in high summer, and in the quiet months the alternative your guest is weighing is a discounted room in one of the hotels on the same shoreline.     Obtain the statutes and the minutes of every meeting at which tourist letting was raised. As at 26 August 2026 a qualified majority may approve or restrict the activity, so what binds you is what your block decided and when. On this strip that decision has gone both ways within a few hundred metres, so read yours before you buy rather than after.

    File the declaration and publish the code

    The operator files a declaración responsable with the tourism authority before letting begins, the dwelling is entered in the Registro de Turismo de Andalucía, and the registration code must appear in every advertisement in any medium. The dwelling also has to hold a licencia de ocupación, which is a document rather than an assumption. All of this was checked on 26 August 2026.

    Bring the bedrooms up to the decree

    The Andalusian decree requires rooms to ventilate directly to the exterior or to a patio and to carry a window-darkening system, alongside fixed cooling in the summer months and heating in the winter ones. On a shoreline where the light is the product, blackout is not a decorative choice. Read as at 26 August 2026, and build the list into the refurbishment budget rather than discovering it after the first booking.

    Guests must present identification so that the entry documentation required of accommodation providers can be completed, and the dwelling's capacity is what has been declared rather than what the sofa bed allows. Seafront flats on this strip were laid out when space was cheap and frequently sleep more people than the declaration covers.     Plan the changeover on the avenue

    Work out, in advance, where a vehicle can stop, how the lift behaves with luggage and where linen is stored. Along much of this strip the avenue itself runs between the blocks and the sand, and in August it is slow in both directions. The nearest rail halt is set back from the seafront, so a guest arriving by train finishes the journey on foot or by taxi.

A flat here earns sharply rather than steadily. The calendar fills around high summer and thins at both ends, and much of the difference between the headline week and the year comes back in cleaning, management, commission and the empty months. Against that sit costs which do not pause: a community charge on a seafront façade, a lift and a garage that age whether or not anyone is staying, and a manager if you are not here. Do the hotels here actually take my guests?

In the quiet months, yes. The municipality's hotel plant runs to almost thirteen thousand beds and most of those establishments stand on this same shoreline, so in spring and autumn your guest is comparing your flat against a discounted room a hundred metres away. In high summer the comparison inverts, because a family of five wanting a kitchen and a terrace cannot be housed in a room at all. Write the listing for that family and let the hotels have the couples.

Does a Puerto Marina block vote differently on letting?

It votes on more than letting, which is the point. A community inside the harbour is already responsible for quays and structures standing in water, so its meetings carry a maintenance agenda that an ordinary block never faces, and the tourist-letting question arrives into that room rather than into an empty one. There is no municipality-wide answer and no marina-wide answer either. Read the statutes and the minutes of your own building, and treat what a neighbouring quay decided as information rather than as precedent.
