A home in Elviria is sold to someone comparing it against Cabopino to the east and Los Monteros to the west, not against central Marbella. The seller's job is to make the comparison easy: an open licence file, a clear terrace band, and a beach named in the paperwork rather than in the headline.

The buyer who reaches an Elviria viewing has usually already seen something at Cabopino and something at Los Monteros, and arrives with a specific question about what the extra or the lesser money buys. That is why a vague listing hurts here more than it does closer to town. Naming the registered beach the property sits behind, naming the terrace it stands on, and naming the community it belongs to answers three of the four questions before the front door opens. The fourth question is always about paperwork, and the seller who has that answer ready has removed the only reason most offers here go slow.

The licence file is the part sellers underestimate. Villas on these terraces have grown over thirty years — a covered porch, a guest studio, a second pool — and the buyer's lawyer will compare the escritura, the Catastro record and what is physically standing. Discovering a gap during the arras period is what turns a good price into a renegotiation. Discovering it before the property is listed is what lets you either regularise it or price it deliberately, on your terms. Who buys in Elviria, and what they weigh it against

The pool is northern European and family-shaped, with Dutch, Belgian, Scandinavian and British buyers well represented, alongside Spanish households moving east out of the town for a plot. What they share is that they are not buying a marina address. They are buying a school run, a beach they can reach without a motorway, and a garden that survives a hot August.

The real competitors are neighbours. To the east, Cabopino offers a marina and a protected dune boundary that guarantees nothing new is coming. To the west, Los Monteros offers beach frontage on larger, older plots at a higher point on the ladder. A home in Elviria wins that comparison on space per euro and on the hospital and schools of the eastern corridor, and loses it whenever the licence file is thin or the community accounts are opaque. Homes here go slowly for exactly two reasons: an unexplained extension, or a price borrowed from the wrong side of the A-7.

    Open the licence file first

    Specific to Marbella

    Before a photograph is taken, your lawyer requests the municipal licence history for the plot and lays it against the escritura and the Catastro record. Where an extension has no paper trail, you decide early whether to regularise it, to disclose and price it, or to leave it out of the marketed surface. All three are defensible. Being surprised is not.

  2. Step 2

    Choose comparables from your own band

    Specific to Marbella

    A beachside apartment and an upper-terrace villa carry the same place name and are not comparable. Paula builds the price from homes on the same side of the A-7, at a similar height, in a community of similar size and charge. A comparable set drawn from the whole of Elviria flatters some sellers and quietly damages others, and buyers here have already spotted the difference.

  3. Step 3

    Assemble the certificates

    You need the energy performance certificate, a certificate from the administrator confirming the community account is clear, the latest IBI receipt and the utility contracts. Gathering them takes days when nobody is waiting and weeks when a buyer is. Having the folder complete on day one is the cheapest negotiating advantage a seller ever buys.

  4. Step 4

    Decide the month you list

    Demand on this stretch is shaped by people who first met the place on holiday. Viewings cluster around the weeks when the beach and the golf course look like the reason to move, and thin out in the deep winter. That is not a rule to obey blindly, but a house that shows badly in February should not be launched in February.

  5. Step 5

    Non-resident retention at completion

    If you are not tax-resident in Spain, the buyer retains a proportion of the price at the notary and pays it over to the Agencia Tributaria on account of your non-resident income tax, using Modelo 211. You then settle or reclaim through your own return. Your lawyer confirms the current rate in writing before completion rather than after it.

    Plusvalía with the Ayuntamiento de Marbella

    Specific to Marbella

    The plusvalía municipal is settled with the Ayuntamiento de Marbella, and since Real Decreto-ley 26/2021 you may choose between the objective method, whose coefficient rises with the years you have held the property, and the real gain between purchase and sale. Where there is no gain at all, the transfer is not subject to the tax.

What comes off the agreed figure is mechanical rather than mysterious. The plusvalía municipal goes to the Ayuntamiento de Marbella, calculated either objectively against the years you have owned or against your real gain, whichever you elect. A non-resident seller sees a retention taken at the notary and paid over on Modelo 211 against their own tax return. Then the lawyer, the agency and any outstanding community charge, which the administrator must certify as clear. Why do buyers here ask which beach so often?

Because the municipality registers four separate strips behind this area and none of them is called Elviria. A buyer who has already viewed elsewhere on the coast has usually learned that the walk to the sand is the fact most often blurred in a listing. Answering it plainly, with the registered name and the actual walking route, converts more viewings than any adjective. It also protects the sale, because a buyer who feels the distance was oversold will use it in the arras negotiation.

Can I sell before regularising an unlicensed extension?

Usually yes, provided it is disclosed and reflected in the price rather than left for the buyer's lawyer to find. Buyers on these terraces are used to houses that have grown, and many will accept a documented discrepancy at an agreed discount. What they will not accept is discovering it after the arras have been signed. Paula's approach is to establish the position, put it in the listing pack and let the buyer price it, which keeps the sale on its original timetable.

Does a community with many pools help or hurt a sale?

Both, and the accounts decide which. Large shared gardens, several pools and long private roads are the reason buyers choose a gated block on this hillside, and they are also the reason the monthly charge sits above a plain block in town. A community that budgets for its own resurfacing and pump replacement sells the amenity. One that funds repairs through repeated special levies sells a liability, and experienced buyers read the last two sets of minutes to tell the difference.
