Marbella published an Avance del Nuevo Plan General on 31 July 2020, took its Documento Inicial Estratégico through environmental processing that September, and produced a PGOM Documento de Aprobación Inicial dated 10 April 2023. Until that process finishes, promoters build where consent is clear and where a plot already sits inside a consolidated urbanisation. In Elviria that means the gaps between existing communities and the occasional replacement of a tired 1980s villa, rather than a new district appearing above the golf course.

For a buyer, the practical effect is that the specific plot matters more than the brand of the promotion. A release of eight or twelve units on an infill site behind the beachside urbanisations is a different risk from a phase of a large scheme, because there is no second phase to absorb a delay and no show house to visit. None of that is a licence, and none of it changes what may be built tomorrow — but it is the reason a buyer cannot simply look up a colour on a zoning map and assume it will hold.

The practical consequence in Elviria is that off-plan supply is thin, plot-specific and hard to generalise about. What is honestly available at any moment is a question for the week you are asking, not for a page: promoters release small numbers of units on consolidated land and sell them before a portal listing exists.     Secure the guarantee before any payment

    Spanish law requires a promoter taking money before completion to cover it with a surety insurance policy or a bank guarantee and to hold the funds in an account separated from its own. That obligation, in its current form, has applied since 2016. No deposit leaves your account before the policy or guarantee is in your lawyer's hands.

    Fix the staged payment calendar

    The purchase contract sets out what is paid at reservation, what at contract, what during construction and what at the notary. Each stage should be tied to a verifiable milestone rather than to a date alone, and each should be covered by the guarantee. Read the penalty clauses for late delivery in the same sitting, because they are the only leverage you will have.

    Follow the works, not the newsletter

    Specific to Marbella

    Appoint your own architect to inspect at the structural, envelope and finishing stages, and to sign off the snagging list. On a small Elviria release there is no marketing suite and no site manager waiting for buyers, so the visit has to be arranged and the report has to be yours rather than the promoter's.

    Wait for the licencia de primera ocupación

    Specific to Marbella

    The licencia de primera ocupación is the municipal certificate that the finished building matches the licence it was granted, and it gates the definitive utility contracts. Completion before it is issued shifts a risk onto you that belongs with the promoter. Your lawyer confirms the position with the Ayuntamiento rather than relying on an assurance from the sales office.

  6. Step 6

    Register, insure and start the clock

    After the notary, the escritura is lodged at the Registro de la Propiedad and the building's own obligations begin. In Marbella a building presents its first technical inspection report in the year after its fiftieth anniversary and renews it every ten years thereafter, so a new home starts a clock that a future owner will inherit along with the keys.

An off-plan purchase in Andalucía is taxed differently from a resale: new build carries IVA plus stamp duty rather than the transfer tax, and your lawyer confirms the current rates in writing before you commit. Beyond tax, budget for the guarantee premium where the promoter passes it on, the architect you appoint to inspect, and the gap between contract and delivery during which the money is committed but the home is not usable. Within Elviria, an infill new build usually sits above the tired resale beside it and below a comparable house on a larger, established plot.

Rarely, and that is a structural feature rather than a temporary lull. Elviria is a consolidated area of existing urbanisations with limited undeveloped land, and Marbella has not yet completed the general plan that would rezone anything at scale. What appears here are small releases on infill plots and single replacement villas. Can I buy a plot and build my own house here?

Sometimes, and the plot's own file decides it. Undeveloped parcels on these terraces are scarce and are usually sold with a known building envelope from the urbanisation's original consent. Before any offer, an architect confirms what that envelope actually permits in height, footprint and setback, and confirms access, water and drainage to the plot. Building your own house here is entirely possible; assuming a vacant plot is buildable because it is vacant is the mistake.

What happens if the promoter delivers late?

That depends entirely on what your contract says and on the guarantee behind your payments. The statutory guarantee covers return of the sums advanced plus legal interest where the works do not start or do not finish as agreed, which is protection against loss rather than against inconvenience. Compensation for a delay that eventually completes is a matter of the penalty clause you negotiated. On a small release with no later phase, that clause is worth more attention than the specification sheet.
