The gated apartment communities below the A-7 are the natural short-let stock here, and they are also where Spain's horizontal-property rules bite hardest. Since the reinstatement of article 17.12 of Ley 49/1960, a community can approve, limit, condition or prohibit tourist letting by a three-fifths majority of owners and quotas, and can set a higher expense quota for the flats that do it. As at 26 August 2026 that is the position. So the first document to read in Elviria is not a licence application; it is the minute book of the community you are buying into.

The second is the layout of the flat itself. Andalucían rules count places rather than rooms: a whole-home let may not exceed fifteen places, a let by rooms six, and no bedroom may be counted for more than four. On this hillside that matters because much of the stock was built for families and has generous, sometimes divisible, rooms. What a property can legally sleep, what it can comfortably sleep and what a portal listing claims are three different numbers, and only the first one survives an inspection. Establishing that number early also settles the furniture plan, because a bedroom counted for four needs storage for four.

The Elviria season, and the licence position in Marbella

The letting year here has a short, intense beach peak from June into September, a useful golf and winter-sun shoulder either side of it, and a genuine long-let market underneath both because families live in the eastern corridor year round. That third layer is what distinguishes Elviria from a purely seasonal resort address: a home that cannot fill August can often still find a nine-month tenant, which is not true everywhere on this coast.

The regulatory picture has two layers and both move. Andalucía governs the tourist-let regime through its decree on viviendas con fines turísticos, which sets the occupation-licence requirement, the fifteen-place ceiling on a whole-home let, the four-per-bedroom limit and the registration code that must appear in advertising. Above and beneath that sit the community's own three-fifths power over the activity and whatever the Ayuntamiento de Marbella has in force on the day. Both are live ground.     Read the minute book before anything

    Confirm the occupation licence

    A property offered for tourist use in Andalucía must hold an occupation licence and meet the technical and quality conditions required of housing. On an older Elviria flat, tracing that licence is occasionally slower than expected, so it belongs at the start of the process.

    The operator files a declaración responsable confirming compliance, which produces an entry in the Registro de Turismo de Andalucía and a registration code.     Plan the calendar around two peaks

    Block the weeks you want for yourself before the calendar opens, because on this stretch the beach weeks and the golf shoulder are the two periods everybody wants. A home that is withdrawn at short notice in August loses more than the booking; it loses the repeat guest who would otherwise have returned every year at the same time.

    Set up the ground operation

    Changeovers, laundry, pool service and a key handover that works at midnight are what separate a home that gets rebooked from one that does not. Distances here are small but the roads fill in August, so a cleaning team that also covers the eastern urbanisations is worth more than one nominally closer but coming from the town centre.

  7. Step 7

    Declare the income correctly

    Letting income is taxable in Spain whether or not you live here, and a non-resident owner files periodically rather than once a year. Your accountant sets the calendar and keeps the invoices for expenses that may be deducted. Doing this properly from the first booking is far cheaper than reconstructing a year of platform payouts afterwards.

A three-bedroom here earns its strongest weeks between mid-June and early September, and the golf shoulder extends rather than replaces that. What compresses the earning season is the same thing that makes the area pleasant: this is a residential hillside, not a resort strip with year-round footfall. Against the gross, set the community charge, pool and garden contracts, changeover costs, the management share and the tax. Is a long tenancy better than short lets in Elviria?
