Off-plan in Málaga: replacement, not land release
New homes in Málaga arrive by replacement, not by land release. The city is built out across its eleven districts, and its largest free parcel — the 177,000 square metres of former Repsol depots — has been argued over since 2006. Off-plan here usually means one licensed building on a known street.

The scarcity is structural, and it is visible on any walk. Málaga was a city before it was a destination, so the Centro, Carretera de Cádiz and Málaga Este were finished long before anybody wanted to sell a render. What appears as new stock in those districts is almost always a replacement building: an old commercial premises taken down, an unfinished corner completed, a plot released by demolition. Teatinos-Universidad is the exception and the reason it matters — it is the newest of the eleven districts, laid out around the campus, and it is where a modern block with a lift, a garage and a predictable layout is genuinely built rather than adapted.
That shape changes the risk you are actually carrying. You are not exposed to a masterplan whose later phases might arrive with different neighbours; you are exposed to one promoter, one licence and one completion date on a street that already exists. Everything therefore turns on documents rather than on the model in the sales office. What the Ayuntamiento has licensed, what the plot is permitted to replace, whether the façade behind the hoarding carries protection, and whether your staged payments are held under a guarantee: those four answers are the purchase. The kitchen finish is a preference; the licence file is the transaction.
What is under construction in Málaga, and where
The clearest illustration of how land works in this city is a single site. The former Repsol land covers 177,000 square metres across the Carretera de Cádiz and Cruz de Humilladero districts and held hydrocarbon depots until 2001. In 2006 the city proposed an alternative of four towers of up to forty storeys carrying 932 dwellings and a hotel; in 2019 the council approved instead the drafting and execution of an urban-forest project, and the ground remains in project. Twenty years of argument over the largest free parcel in Málaga is the single most useful fact an off-plan buyer here can hold.
The practical reading is not pessimistic, it is corrective. New homes do get built, but they arrive one licence at a time and mostly in Teatinos-Universidad, the newest of the eleven districts, or as replacement buildings inside the older ones. So a brochure showing a phased quarter should be checked against what the Ayuntamiento has actually granted for that plot, and a completion date should be read as a function of the licence, the protection on the elevation and the width of the street a crane has to work from.

Sort replacement from refurbishment
In a built-out city the word new covers three different products: a genuinely new building on a cleared plot, a shell retained behind a preserved façade, and a heavy refurbishment sold with fresh photographs. Ask which one you are being offered, in writing, before anything else. The tax treatment, the guarantees and the structural cover all differ between them.

Ask the Ayuntamiento which licence exists
Specific to Málaga
A licencia de obra is a municipal act with a file number, a date and a scope, and the Ayuntamiento de Málaga answers for it rather than the sales office. Have your lawyer request the file for the exact plot and read what was granted, not what is being advertised. A scheme marketed before its licence is granted is a scheme whose delivery date is a forecast.

Test what the plot may replace
Specific to Málaga
In the Centro and the older streets, protection frequently governs the elevation, the openings and sometimes the roofline, which decides whether a building can be replaced at all or only rebuilt behind its own front. That answer comes from municipal planning and it should be in the file before you pay a reservation. It is also what sets the real completion date, because a protected front slows a site.

Step 4
Insist on the aval before paying
Every sum you hand over before the building exists must be covered by a bank guarantee or an insurance policy, paid into a special account and returnable if the promoter fails to deliver. That protection descends from Ley 38/1999 and is governed today by Ley 20/2015. Do not accept a reservation receipt as a substitute, and do not release a stage payment until the corresponding certificate is in your lawyer's hands.

Step 5
Pin the finish schedule to the deed
Attach the memoria de calidades, the floor plan and the surface schedule to the private contract so that the specification is a contractual term rather than a brochure. Name what is included down to the level of the kitchen appliances and the parking title. In a replacement building on a tight urban plot, storage, ventilation and where the bins go are worth more argument than the tap fittings.

Step 6
Wait for the LPO, then move
The licencia de primera ocupación is the municipal confirmation that what was built matches what was licensed, and it gates the utility contracts and most lenders. Do not complete against a promise that it is imminent. Ask for the document, check the address and the unit reference on it, and only then sign, connect the supplies and take the keys.
A new home is taxed differently from a resale: IVA on the price and AJD on the deed instead of the transfer tax, with the current rates confirmed by Paula's lawyer in writing rather than quoted from a page. The shape of the payment differs too, since money leaves in stages against a guarantee rather than in one movement at the notary. What is local is the parking: even in new city stock the space is a separate title with its own price, and in a replacement building on a narrow plot there may be fewer spaces than flats. Ask before you assume one comes with the home.

Sometimes, and the answer belongs to municipal planning rather than to the promoter. Much of the historic core carries protection that governs the elevation, the openings and occasionally the roofline, so a site may be permitted only as a rebuild behind its own retained front. That is not a small distinction for a buyer: it changes the internal layout that is achievable, the programme on site and, often, the delivery date. Have the planning position for the specific plot in the file before any money moves, and read what it permits rather than what it is hoped to permit.

How long does a licence file take to check properly?

Long enough that it should start before the reservation, not after it. Your lawyer needs the municipal file for the plot, the promoter's title, the description of what is being built, the guarantee documents for the staged payments and the planning position on the elevation. In a replacement building those five arrive from different places and at different speeds. Paula's practice is to make the reservation refundable until the file is complete, so that a slow answer costs you time rather than money.
