Letting in Málaga, where the year starts in September
Málaga lets on an academic and working calendar, not a beach one. Cruise passengers sleep on the ship and the Feria lasts nine days, so the tenant who signs a contract is a student, a hospital or office worker, or a household moving into the city — and new nightly registration is currently suspended on residentially zoned land.

The first thing to unlearn about letting here is the coastal reflex that August is the year. A cruise call is a day visit and its passengers sleep aboard; the Feria fills nine days with people who mostly live in the province already; Semana Santa is a week. None of those signs a contract. What signs a contract is the university term at Teatinos and El Ejido, a rota at one of the hospitals, a post at an office in the Soho or out on the western corridor, or a family arriving in the city because somebody took a job. Set the flat up for that person and the calendar looks after itself.
The second thing is that the building lets the flat, exactly as it sells it. A tenant signing for a year will ride the lift, count the floors, look for somewhere to leave a bicycle and ask what happens to the bins. In a nineteenth-century Centro stairwell those answers are often awkward, and the honest response is to say so in the listing rather than at the door. Heating is the underrated one: a stone building in the old streets is genuinely cold in January, and a flat that cannot be warmed loses the twelve-month tenant to a plainer block in Teatinos with a lift and double glazing.
The season in Málaga, and the licence position in the municipality
Take the regulation first, because it is the part that dates. As at 26 August 2026 the Ayuntamiento de Málaga has in force a three-year suspension of new tourist-flat and hotel licences on residentially zoned land, which arrived in mid-2026 on top of earlier restrictions. Above the municipal layer sits the Andalusian one: Decreto 28/2016, de 2 de febrero, requires a licencia de ocupación, a declaración responsable filed before the first guest, inscription in the Registro de Turismo de Andalucía and the code shown in every listing, and it excludes a dwelling let to one tenant for more than two continuous months. What no page can tell you is what will be granted for a specific address. Ask the town hall in writing, on the day you commit.
The season, read properly, is not the summer. What produces a twelve-month tenant is the university term, the hospitals, the offices and the employment out along the western corridor. That is why a Málaga letting year runs from September to June rather than from June to September, and why heating decides more here than a terrace does.

Since 3 April 2025 a building held in horizontal division needs express approval by three fifths of owners representing three fifths of the quotas before tourist letting may begin. The Universidad de Málaga carries more than 35,000 students between the Teatinos and El Ejido campuses, and their year sets the rhythm of the long-let market in the districts around them. Bring the flat to market in the weeks before term rather than in July, furnish it for study rather than for holidays, and expect the questions to be about the internet connection and the walk to the faculty.

Make the building liveable in January
Heating, glazing and hot water decide whether a flat holds a tenant through the winter months, and in an old stone building they are usually the works nobody has done. Air conditioning matters for a handful of weeks; warmth decides the other half of the year. Fix that before you spend anything on styling, because a cold flat is re-let every spring and a warm one is not.

Manage the door and the deliveries
In a dense centre the operational problems are all at street level: where a van can stop, whether a parcel can be left, how the bins work, and who holds a key when the tenant is away. Agree those with the porter or the administrator at the start of the tenancy and write them into the handover notes. They are what generates the calls, and they are the part an absent owner cannot improvise.
A Málaga flat earns steadily rather than spectacularly, and it earns across the whole year instead of across a short season. A resident household, a relocating employee or a shared student tenancy pays less per night than a holiday guest and costs almost nothing to service: one changeover a year rather than one most weeks, no laundry contract, no key handover at midnight. Against that, the building takes the wear of continuous occupation and a tenant has statutory protection a guest does not. What can I let a Málaga flat as while the suspension runs?

Ordinary residential letting is unaffected, and in this city it is the larger market anyway. As at 26 August 2026 the suspension concerns new tourist-flat and hotel licences on residentially zoned land, not a twelve-month tenancy, an academic-year let or a medium-term let to somebody relocating. What it does mean is that a plan built on nightly income needs a written answer from the Ayuntamiento for your exact address before you commit, and that an existing registration attached to a property is a separate legal question your lawyer must examine on its own terms.

Does an academic-year let need a tourist registration?

No, and the reason is written into the Andalusian decree itself. Decreto 28/2016 excludes from the tourist regime any dwelling let to the same tenant for more than two continuous months, and a course-length tenancy is comfortably past that line. It is an ordinary residential letting, with an ordinary contract, an ordinary deposit and ordinary tenant protection. That is the point: in a city with more than 35,000 students, the regime most owners actually need is the one that requires no tourism paperwork at all. Have your lawyer draft the contract for the term you intend.

Is a flat without a lift lettable long term here?

Yes, but to a narrower tenant and at a plainer level. A second floor without a lift finds students and younger professionals without much trouble; a fourth or fifth floor loses families with pushchairs, anyone with a mobility question and most tenants over sixty. In the older districts a great deal of stock is exactly that, so the practical response is to describe the stairs honestly, price accordingly, and check the community's minutes for any lift project already voted, because that changes the flat's audience permanently.
